Individual economic and legal aspects of the formation and development of reinsurance

On the basis of the economic and legal approach of the doctrine of the economic rights, some of the economic and legal aspects of the formation and reinsurance development are explored in the article. First of all, the attention is drawn to the emergence of reinsurance as economic and legal structures and the initial stages of its development. An attempt to assess the socio-economic conditions conducive to the emergence of reinsurance services, including those, that directed historical and legal development of these relations, is made. Among other things, it was concluded that the determining factor in the evolution of reinsurance is the progress of production and economic relations.На основі економіко-правового підходу доктрини господарського права у статті досліджуються окремі господарсько-правові аспекти становлення та розвитку перестрахування. Звертається увага на зародження перестрахування як господарсько-правової конструкції та початкові етапи його розвитку. Дається спроба оцінки суспільно-економічних передумов, що сприяли появі послуг перестрахування, у тому числі тих, які спрямовували історико-правовий поступ даних відносин. Зроблено висновок, що визначальним чинником еволюції перестрахування є прогрес виробничо-господарських відносин
