Penyelesaian Sengketa E-Commerce melalui Online Dispute Resolution dalam Perspektif Hukum Islam

The massive use of the internet throughout the world may trigger a number of emerging disputes among its users. Lots of websites have been developed to help resolve these internet-caused disputes and facilitate the resolution to the dispute cases that occur offline to be more transparent, accountable, and practical through online channels (Online Dispute Resolution –later known ODR). The present study aims to explore how the practices of resolving e-commerce disputes are carried out through ODR in the perspective of Islamic law. Grounded in library research, the study employed a normative-juridical approach. The data were collected from various resources, such as books and journal articles highlighting the relevant issue. Descriptive-analytical method was used to systematically describe the obtained facts factually and accurately for providing in-depth analysis. The findings demonstrate that ODR practices, the extension of Alternative Dispute Resolution (ADR) practices, coped with a strong historical and legal foundation. It indicates that ODR practices in Islamic law are permitted with the exception of severe contracts containing elements prohibited by Islamic tenets, including elements of obscurity (gharar), harm objects, indicated fraud (tadlis), gambling (maysir), and usury
