Kontekstualisasi Hukum Keluarga Islam di Indonesia

The nature of the rights of women and children can be seen from the Basic Law or Constitution which encourages the use of family law in Indonesia, especially for Muslims. This is for legal certainty for the lives of women, wives, mothers and children to be protected. Islamic family law in Muslim countries, especially in Indonesia, has a different position for Muslims, because it is important for parents to maintain security and comfort in the family. This paper will conduct an elaboration study on the application of Islamic Family Law in the Law Number. 1 of 1974 concerning Marriage and Compilation of Islamic Law. This type of research is qualitative research, collecting data that is done through good reading material in the form of books that discuss the problems studied, journals and other sources. Secondary data is obtained from the literature relating to the research conducted. The results of this study indicate that Islamic family law in Indonesia still needs to be guarded and counted again.
