Legal regulation of the agricultural land fund

This diploma thesis deals with the issue of protection of agricultural land fund in order to define the various legal instruments and try to evaluate the current legislation in relation to the protection of quality and especially the quantity of agricultural land. The agricultural land is one of the most valuable types of land, representing about 54 percent of the total area of the Czech Republic which, however, has been quite negatively affected by interventions causing its loss and deterioration of its quality for decades. Legal instruments should thus be an effective means of averting and preventing growing interference with agricultural land as one of the components of the environment. The aim of this work is to evaluate the legal instruments by which agricultural land can by most affected and thus protected. The whole work is divided into four chapters, the key ones being the last three dealing with the subject of the work itself, ie the protection of the agricultural land, which has been increasingly affected by increasing and accelerating degradation processes in recent years. The first chapter characterizes the key and basic concepts of land and agricultural land which are the basic for the following chapters, and then contains the main sources of land protection legislation, not only...Tato diplomová práce se zabývá problematikou ochrany zemědělského půdního fondu s cílem vymezit jednotlivé právní nástroje a pokusit se o zhodnocení platné právní úpravy ve vztahu k ochraně kvality a zejména kvantity zemědělské půdy. Zemědělská půda je jednou z nejcennějších druhů půdy představující zhruba 54 procent celkové rozlohy České republiky, která je však již po desítky let dosti negativně ovlivňována zásahy způsobujícími její úbytky a zhoršování její kvality. Právní nástroje by tak měli být účinným prostředkem k odvrácení a zamezení rostoucích zásahů do zemědělské půdy, jakožto jedné ze složek životního prostředí. Záměrem práce je zhodnotit právní nástroje, kterými může být zemědělská půda nejvíce ovlivněna, a tedy chráněna. Celá práce je rozčleněna do čtyř kapitol, z nichž stěžejními jsou poslední tři pojednávají o samotném předmětu práce, tedy o ochraně zemědělské půdy, jež je v posledních letech stále více zasažena zvyšujícími se a zrychlujícími degradačními procesy. V první kapitole jsou nejprve charakterizovány klíčové a základní pojmy půda a zemědělský půdní fond, jež jsou základem pro následující kapitoly práce, a poté jsou zde obsaženy stěžejní prameny právní úpravy ochrany půdy, a to nejen z oblasti vnitrostátní, ale také mezinárodní a evropské.
