The dignity of women in the brazilian prison system: an analysis from the perspective of the Magna Carta and the aggravation of the violation of fundamental rights in prison space

The present end-of-course paper has as its theme the situation of incarcerated women in Brazil, and aims to analyze the applicability of the principle of human dignity within female prisons elucidating their reality and the way the prison system treats them. It is noted that in the current context, the female prison population goes through a picture of huge violations of rights, in this bias, this work shows the importance of addressing this issue and the rights of this population. The relevance of this approach is related to the growth of the female prison population in relation to the male. The general objective is to reflect on the 2 conditions surrounding the incarceration of women and to verify whether the constitutional assumptions are observed, since it is the State's responsibility to ensure minimum conditions that guarantee the dignity of the human person and it was evidenced that in practice, respect for the aforementioned assumption is not observed. Based on this fact, this study was developed through a survey of bibliographic research in works related to the theme, involving the reading, summarizing, as well as several official statistical data regarding female incarceration. It is essential to promote the debate and highlight the need for effective public policies to promote the dignity of the human person in attention to the fundamental rights and guarantees constitutionally guaranteed in relation to imprisoned women.Trabalho de Conclusão de Curso (Graduação)O presente trabalho de conclusão de curso possui como temática a situação das mulheres encarceradas no Brasil, e tem como objetivo analisar a aplicabilidade do princípio da dignidade da pessoa humana dentro dos presídios femininos elucidando sua realidade e o modo como o sistema penitenciário as trata. Nota-se que no contexto atual, a população carcerária feminina perpassa por um quadro de enormes violações de direitos, nesse viés, este trabalho mostra a importância de se tratar desse tema e dos direitos dessa população. A relevância dessa abordagem está relacionada ao crescimento da população carcerária feminina em relação à masculina. O objetivo geral é refletir acerca das condições que envolvem o encarceramento feminino e verificar se os pressupostos constitucionais são observados, pois compete ao Estado assegurar condições mínimas que garantam a dignidade da pessoa humana e restou evidenciado que na prática, o respeito ao mencionado pressuposto não é observado. Partindo desse fato, esse estudo foi desenvolvido através do levantamento de pesquisa bibliográfica em obras correlatas ao tema, envolvendo a leitura, fichamento, bem como diversos dados estatísticos oficiais a respeito do encarceramento feminino. É imprescindível promover o debate e destacar a necessidade de efetivar políticas públicas para a promoção da dignidade da pessoa humana em atenção aos direitos e garantias fundamentais assegurados constitucionalmente no que tange às mulheres presas
