Gender inequality and law: an analysis of female participation in the construction of brazilian society

Since the beginning of the 19th century, the debate for equal civil and political rights between women and men has gained strength in the West, the first expressions of this trend being the suffragist movements and workers' struggles of the 1900s. female participation in the construction of Brazilian society has evolved a lot. However, there is still much to be done in the search for the realization of the much-vaunted equality that has been stamped in several Brazilian constitutions since the end of the last century. The present work approaches this theme from a legal and historical point of view, making a brief description of the most important moments for the achievement of gender equality by women. At first, we sought to demonstrate how gender inequality has always been present in Brazil, needing to be, sometimes, energetically fought by the legislator. After a brief explanation was made about the process of female emancipation in Brazil and at the end it was concluded by demonstrating how the national judiciary itself is still lacking in female participation, maintaining social standards evidently oriented by the male portion of the population.Pesquisa sem auxílio de agências de fomentoTrabalho de Conclusão de Curso (Graduação)Desde o início do Século XIX o debate pela igualdade de direitos civis e políticos entre mulheres e homens tem ganhado força no ocidente, sendo as primeiras expressões dessa tendência os movimentos sufragistas e as lutas operárias dos anos 1900. De lá pra cá muita coisa mudou e a participação feminina na construção da sociedade brasileira evoluiu bastante. Contudo, ainda há muito que ser feito na busca pela concretização da tão propalada igualdade que vem estampada em diversas constituições brasileiras desde os idos do século passado. O presente trabalho vem abordar essa temática do ponto de vista jurídico e histórico, fazendo uma breve descrição dos momentos mais importantes para a conquista da igualdade de gênero pelas mulheres. Num primeiro momento buscou-se demonstrar como a desigualdade de gênero sempre esteve presente no Brasil, precisando ser, às vezes, energeticamente combatida pelo legislador. Após fez-se uma breve explanação sobre o processo de emancipação feminina no Brasil e ao final concluiu-se demonstrando como o próprio Judiciário nacional ainda é carente da participação feminina, mantendo padrões sociais evidentemente orientados pela parcela masculina da população
