La prison en débats sous la IIIe République. Une philosophie pénale au cœur de la République

International audienceDuring the Third Republic, the prison was the subject of numerous discussions between philanthropists and politicians, as the elites saw prison reform as a means of resolving the social question. The reform project was constitutive, major, predominant, for this young Republic in search of legitimacy, which demonstrated an inventive capacity in the creation of politics. It is the reform that initiates a number of projects in this period and it is not so much the prison itself that is discussed as what can prevent its access or return. We will focus specifically on the law of 27 May 1885 on recidivists and the law of 14 August 1885 on the means of preventing recidivism, and we will show in what way they reveal a republican society under construction, and in what way they make it possible to understand the dynamics of change and regulation at work in the republican state. These laws, as well as the national debate that presided over their adoption, are at the very heart of the edifice that will lead to the constitution of a modern welfare state in which the penal law, the very basis of the republican political bond, appears as the only alternative to the shortcomings of a chipped social pact. The penal law thus becomes a privileged instrument in the construction of the State, and settles at the foundation of the democratic identity.La prison est sous la IIIe République, l’objet de nombreuses discussions entre les philanthropes et les hommes politiques car les élites voient dans la réforme pénitentiaire un moyen de résoudre la question sociale. Le projet de réforme est constitutif, majeur, prédominant, pour cette jeune République en quête de légitimité, qui témoigne ici d’une capacité inventive dans la création du politique. C’est la réforme qui initie nombre de projets en cette période et ce n’est pas tant la prison en soi qui est discutée que ce qui peut en éviter l’accès ou le retour. Nous nous attacherons spécifiquement à la loi du 27 mai 1885 sur les récidivistes et à la loi du 14 août 1885 sur les moyens de prévenir la récidive, et nous montrerons en quoi elles sont révélatrices d’une société républicaine en construction, et en quoi elles permettent de comprendre les dynamiques de changement et de régulation à l’œuvre dans l’État républicain. Ces lois, ainsi que le débat national qui présida à leur adoption, se trouvent au cœur même de l’édifice qui aboutira à la constitution d’un État-Providence moderne où la loi pénale, base même du lien politique républicain, apparaît comme la seule alternative aux carences d’un pacte social ébréché. La loi pénale devient ainsi un instrument privilégié dans la construction de l’État, et s’installe au fondement de l’identité démocratique
