Patrick CHAUMETTE Professor Emeritus of the University of Nantes On December 12, 1999, the oil tanker Erika, flying the Maltese flag, chartered by Total, en route from Dunkirk to Livorno, broke up and sank off Penmarc'h, at the southern tip of the Finistère, letting 20,000 tonnes of heavy fuel oil escape. Driven by the storms at the end of the year, the oil then came to sully 400 km of coastline, from Finistère to Charente-Maritime. This sinking occurs within the framework of a violent storm which crossed the northern part of France to the Vosges. It will be followed on December 27 and 28, 1999 by a southern storm which will ravage the Landes forests, as well as the central massif. This second storm obviously agitated and more the Bay of Biscay. After a month of cleaning, 115,000 tonnes of a mixture of fuel oil and waste will be recovered. This ecological disaster killed between 150,000 and 300,000 seabirds, stuck in the water. The shipowner was Giuseppe Savarese, Italian, supported by the technical management of the Panship company. RINA was the classification society, an Italian society until then of good reputation, member of the International Association of Classification Societies (IACS). Total was only a charterer, so to speak, but had concluded the charter on time, whereas other oil companies had indicated that they refused this old ship. This question of vetting, and of a fault in the control of the vessel by the chartering oil company, will be essential. The economic damage is estimated at nearly one billion euros, according to the firm Mazars and Guérard. The question of restoring the coast will be important1, as will that of preventing further shipwrecks2. Obviously the issues of civil liability and compensation were just as essential. I-A criminal procedure. As with the sinking of the Amoco Cadiz in Chicago, national procedures will be implemented, likely to give very variable results, but based on the polluter-pays principle in order to obtain greater compensation to the ceilings provided for by the international conventions concluded under the aegis of the International Maritime Organization. In this sense, it is relevant to compare the French procedures related to the Erika, and the Spanish procedures related to the Prestige, a 26-year-old oil tanker, flying the flag of the Bahamas, wrecked on November 19, 2002, off the coast of Galicia. The fuel oil transported by the ship, broken in two, seriously soils Galicia, but also the Portuguese coasts, spreads in the Bay of Biscay, then on the French coasts of the Landes, Charente, Vendée to southern Brittany. In both cases, the procedure was criminal, with a view to criminal sanctions, but also to compensation for the civil parties and their damages, based on ratified international conventions, but also in France on national law3. Ce naufrage intervient dans le cadre d'une violente tempête qui a traversé la partie nord de la France jusqu'aux Vosges. Elle sera suivie le 27 et 28 décembre 1999 par une tempête sud qui va ravager les forêts landaises, ainsi que le massif central. Cette seconde tempête a évidemment agité et plus le golfe de Gascogne. Après un mois de nettoyage, 115 000 tonnes d'un mélange de fioul et de déchets seront récupérées. Cette catastrophe écologique a tué entre 150 000 et 300 000 oiseaux marins, englués. L'armateur était Giuseppe Savarese, italien, appuyé sur la gestion technique de la société Panship. RINA était la société de classification, société italienne jusque là de bonne réputation, membre de l'association internationale des sociétés de classification (IACS). Total n'était qu'affréteur, si l'on peut dire, mais avait conclu l'affrètement à temps, alors que d'autres sociétés pétrolières avait indiqué qu'elles refusaient ce vieux navire. Cette question du vetting, et d'une faute dans le contrôle du navire par la société pétrolière affréteuse, sera essentielle. Le préjudice économique est évalué à près d'un milliard d'euros, selon le cabinet Mazars et Guérard. La question de la remise en état de la côte sera importante1, tout comme celle de la prévention d'autres naufrages2. Evidemment les questions de responsabilité civile, d'indemnisation ont été tout aussi essentielles. I-Une procédure pénale. Comme pour le naufrage de l'Amoco Cadiz à Chicago, ce sont des procédures nationales qui vont être mises en oeuvre, susceptibles de donner des résultats très variables, mais de s'appuyer sur le principe pollueur-payeur afin d'obtenir des indemnisations supérieures aux plafonds prévues par les conventions internationales conclues sous l'égide de l'Organisation Maritime Internationale. En ce sens, il est pertinent de comparer les procédures françaises liées à l'Erika, et les procédure espagnoles liées au Prestige, pétrolier de 26 ans, battant pavillon des Bahamas, naufragé le 19 novembre 2002, au large de la Galice. Le fioul transporté par le navire, cassé en deux, souille gravement la Galice, mais aussi les côtes portugaises, se répand dans le golfe de Gascogne, puis sur les côtes française des Landes, de Charente, de Vendée jusqu'en Bretagne sud. Dans les deux cas, la procédure fut pénale, en vue de sanctions pénales, mais aussi d'une indemnisation des parties civiles et de leurs préjudices, en s'appuyant sur les conventions internationales ratifiées, mais aussi en France sur le droit national3. Le TGI de Paris, le 16 janvier 2008 a rendu un jugement assez innovant, que la cour d'appel de Paris le 30 mars 2010 n'a pas entièrement suivi
