The Diplomatic Protection of the Ukrainian Refugees by their State of Asylum. A Possible Scenario of the Day-After the Russian-Ukrainian Conflict

Il saggio indaga sulla possibilità per lo Stato che ha accolto i rifugiati di agire in protezione diplomatica contro lo Stato che ha provocato la fuga dei rifugiati stessi. Ciò alla luce dell'art. 8 del Progetto di articoli della Commissione del Diritto internazionale sulla protezione diplomatica. La questione si pone oggi in relazione all'enorme flusso di rifugiati ucraini nei paesi limitrofi europei, principalmente la Polonia, l'Ungheria, la Romania e la Moldavia.The essay investigates the possibility for the State that has received and recognized the refugees to resort to diplomatic protection against the State that caused the refugees to flee. This in the light of art. 8 of the Draft Articles of the International Law Commission on diplomatic protection. The question arises today in relation to the huge flow of Ukrainian refugees into the European bordering countries , mainly Poland, Hungary, Romania and Moldova
