This short paper is actually a note to a judgement issued by the Court of Justice of the EU in an immigration case, and it is meant to analyse the relationship between the European States' policies as to the reception of immigrants and the disciplinary function of legal power. After a thorough explanation of Zubair Haqbin's case and the Court's resolution, I will reckon the effect of provisional exclusion from the reception system on the immigrant's freedom of movement
