KETENAGAKERJAAN DALAM UNDANG-UNDANG NOMOR 11 TAHUN 2020 TENTANG CIPTA KERJA PERSPEKTIF HAK ASASI MANUSIA DAN SIYASAH SYAR’IYYAH

This research is motivated by the rejection and negative criticism of the ratification of Law Number 11 of 2020 concerning Job Creation related to the employment cluster. The establishment of the Employment Creation Law in the employment cluster is a breakthrough made by government officials in the legal field with the aim of correcting overlapping, especially conflicting or similar laws and regulations and then changes will be made to regulations. Therefore, the focus of the study in this thesis is First, How is the Urgency of Human Rights in Indonesia in Law Number 11 of 2020 concerning Job Creation in the Employment Cluster. Second, how is Law Number 11 of 2020 concerning Job Creation in the Employment Cluster based on the Siyāsah syar'iyyah perspective. The type of research used is library research, that is, researchers by studying and analyzing written sources related to the object of discussion to obtain clear data, so that can help in this study, and this type is related to what presented in a new way. Based on the results of the study, it can be concluded that: first, Human Rights (HAM) views the Job Creation Act in the Manpower Cluster which has been ratified on October 5, 2020 by the House of Representatives (DPR) so that until it is stipulated as Law Number 11 of 2020 concerning Job Creation in Employment clusters with the aim of creating job opportunities and increasing foreign and domestic investment by reducing regulatory requirements for business permits and land acquisition. Second: Siyasah Syar'iyah's view of the Job Creation Law in the Employment Cluster until it is ratified into Law Number 11 of 2020 concerning Job Creation in the Employment Cluster if it is viewed from an Islamic point of view, namely the Siyasah Syar'iyah view which is produced by human thought based on ethics, Religion, and Morals by taking into account the general principles of the Shari'ah in regulating human life in society and the state
