The republican theory of the free state and the free citizen: historical beginnings, philosophical foundations, political imprints, and interpretive re-approaches in contemporary constitutional theory

The republican theory, together with the theories of the social contract and utilitarianism are an integral part of Modernity. After a decline in republican ideas, the so-called "republican turn" has taken place in the last 40 years, both at the level of political philosophy and theory. This shift acquires a multidisciplinary character and extends to constitutional theory, through the bridge of political constitutionalism, the roots of which can be found in the evolution of British constitutionalism. This contribution attempts to transfer the republican tradition and political constitutionalism to the Greek constitutional theory, through a network of guarantees and examples, with the aim of revitalizing and renewing constitutionalism, in an era of constant changes and challenges, introducing an alternative lens of interpretation to modern constitutional theoryΗ ρεπουμπλικανική θεωρία, από κοινού με τις θεωρίες του κοινωνικού συμβολαίου και του ωφελιμισμού αποτελούν αναπόσπαστο κομμάτι της Νεωτερικότητας. Μετά από μία κάμψη των ρεπουμπλικανικών ιδεών, συντελείται τα τελευταία 40 χρόνια η λεγόμενη "ρεπουμπλικανική στροφή", τόσο σε επίπεδο πολιτικής φιλοσοφίας, όσο και θεωρίας. Η στροφή αυτή αποκτά πολυπειθαρχικό χαρακτήρα και επεκτείνεται και στη συνταγματική θεωρία, μέσω της γέφυρας του πολιτικού συνταγματισμού, οι ρίζες του οποίου εντοπίζονται στην εξέλιξη του βρετανικού συνταγματισμού. Η συμβολή αυτή αποπειράται την μετάγγιση της ρεπουμπλικανικής παράδοσης και του πολιτικού συνταγματισμού στην ελληνική συνταγματική θεωρία, μέσα από ένα πλέγμα εγγυήσεων και παραδειγμάτων, με στόχο την αναζωογόνηση και την ανανέωση του συνταγματισμού, σε μία εποχή διαρκών αλλαγών και προκλήσεων, εισάγοντας έναν εναλλακτικό φακό ερμηνείας στη σύγχρονη συνταγματική θεωρί
