L'APPLICATION DE LA DÉCLARATION UNIVERSELLE DES DROITS DE L'HOMME PAR LA COUR AFRICAINE DES DROITS DE L'HOMME ET DE PEUPLES.: Qui trop embrasse mal étreint !

International audienceArticles 3 and 7 of the Protocol relating to the African Court on Human and Peoples’ Rights (African Court Protocol, Ouagadougou Protocol or Protocol) authorize the latter to interpret and apply, in addition to the African Charter on Human and Peoples’ Rights (African Charter), “any other relevant instrument relating to human rights and ratified by the States concerned”. Therefore, the African Court frequently applies the Universal Declaration of Human Rights, either to legitimize the universalism of the rights in question, or as a direct source of subjective rights. This last hypothesis is not exempt from problems regarding the specificities of the African human rights system. The audacity of the Court, coupled with an overzealous exercise of the possibilities offered by Articles 3 and 7 of the Ouagadougou Protocol, risks leading to an attenuation of the material content of the African Charter. L’audace de la Cour, couplée à un exercice trop zélé des possibilités offertes par les articles 3 et 7 du Protocole de Ouagadougou, risque de conduire à une atténuation du contenu matériel de la Charte africaine.
