Le Pouvoir Local en Tunisie entre l'Ancien Régime et la Révolution. : Essai sur l'émergence de la décentralisation politique

A reflection about the Local Power can only be envisaged through doctrinal constructs aimed at admitting a kind of political decentralization within the unitary State. The specificity of the Tunisian case can be explained by the political changes that have affected Tunisia since January 2011. For this reason, the question should not be considered only in terms of the positive law, but it is part of a continuum, hence the relevance to be situated in its context: between the old regime and the revolution. The independent State has increased a centralized administrative and territorial organization to meet the imperative of national construction. The revolutionary event is part of the local, focus of institutional dysfunction, and regional disparities. The project of decentralization is therefore a challenge, but also a necessity whose success will determine the culmination of a change in the culture of the State. In fact, more than a modality of administrative organization, decentralization calls for substantial change in relations between the State, territory and citizen. This will involve the passage of the simple state domination to the structural duality of the State power that admits a possible pluralism within it. From now on, state/public power is exercised through two channels allowing a dual expression of power: one national, the other local. In this, we add the new modalities of legitimation operating by this way a passage of power- sovereignty to power- legitimacy. Local power, between democratization and liberalism, is a new modality of the exercise of public power.Une réflexion sur le Pouvoir Local n’est envisageable qu’à travers les constructions doctrinales visant à admettre une sorte de décentralisation politique au sein de l’État unitaire. La spécificité du cas Tunisien s’explique par les changements politiques intervenus en janvier 2011. C’est pour cette raison, la question ne doit pas être saisie seulement au regard du droit positif mais elle s’inscrit dans un continuum, d’où la pertinence de la situer dans son contexte ; entre l’Ancien Régime et la Révolution. L’État indépendant, a amplifié une organisation administrative et territoriale centralisées afin de répondre à l’impératif de la construction nationale. L’évènement révolutionnaire est parti du local, foyer de dysfonctionnement institutionnel, et des disparités régionales. Le chantier de la décentralisation constitue dès lors un défi, mais aussi une nécessité dont la réussite déterminera l’aboutissement d’un changement de la culture même de l’État. En effet, plus qu’une modalité d’organisation administrative, la décentralisation appelle un changement substantiel quant aux rapports entre l’État, territoire et citoyen. Cela impliquera le passage de la simple domination étatique à la dualité structurale de la puissance étatique qui admet un possible pluralisme en son sein. Désormais, la puissance étatique/publique s’exerce à travers deux canaux permettant une expression duale du pouvoir : l’un national, l’autre local. En cela, on rajoute les nouvelles modalités de légitimation opérant de la sorte un passage de la puissance- souveraineté à la puissance- légitimité. Le pouvoir local, entre démocratisation et libéralisme, est une nouvelle modalité de l’exercice de la puissance publique
