Le chapitre ‘Commerce et environnement’ de l’Accord Économique et Commercial Global (AECG/CETA) face à l’urgence climatique

The Comprehensive Economic and Trade Agreement between the European Union and Canada (CETA) and the Paris Agreement on climate change were framed and negotiated in parallel, at a time when some voices are calling for “ defragmenting” international climate law in order to better reconcile the requirements of free trade and the fight against global warming. Chapter 24 of CETA is explicitly dedicated to the issue of “ trade and environment”. But this agreement perpetuates a conventional approach to mutual support that can be problematic at a time when the Paris Agreement renationalizes climate objectives and when the climate crisis can no longer be thought of as a purely environmental problem.L’Accord économique et commercial global entre l’Union européenne et le Canada (AECG/ CETA) et l’Accord de Paris sur le climat ont été pensés et négociés parallèlement, à une époque où certaines voix s’élèvent appelant instamment à «dé-fragmenter » le droit international du climat afin notamment de mieux concilier les exigences du libre-échange et celles de la lutte contre le réchauffement climatique. Le chapitre 24 de l’AECG est consacré explicitement à la question «commerce et environnement » . Mais cet accord perpétue une approche classique du soutien mutuel qui peut s’avérer problématique à l’heure où l’Accord de Paris renationalise les objectifs climatiques et où la crise climatique ne peut plus être pensée comme un problème purement environnemental.Grosbon Sophie.
