O reagrupamento familiar do imigrante na UE e o direito fundamental a viver em família

The right to family reunification of the immigrant instigates the collation of various international, European and national laws in the territory of Member States. And because the family is the foundation of human relations in every corner of the planet, the importance of the debate on this topic is clear. At international level, there are norms that guarantee the right of all to live in a family, namely the Universal Declaration of Human Rights. In the European Union there is a specific Directive on immigrant family reunification and a whole range of jurisprudence on the subject. In the national sphere, there are the norms regulating immigration with their state migration policies, which govern the entry and residence of the family members of already admitted immigrants. The right to live in a family is internationally protected, this is crystal clear in the face of universally accepted international standards. It remains to be seen whether, in the face of national sovereignty with regard to immigration regulation, there is an unequivocal duty of States to guarantee immigrants the right of their families to entry and residence in their territories. This in itself raises two controversial points: who would be this family or these relatives to be reunited in the legal field, is one point. And, furthermore, if this family reunification is then presented as a fundamental right to be indisputably safeguarded by States, this is another issue to be discussed in this work.O direito ao reagrupamento familiar do imigrante instiga a colacionar vários ordenamentos internacionais, europeus e nacionais, no território dos Estados-membros. E por ser a família um alicerce das relações humanas em todos os cantos do planeta, percebe-se a importância do debate deste tópico. Em nível internacional, há normas que garantem o direito de todos a viver em família, nomeadamente a Declaração Universal dos Direitos Humanos. No cenário da União Europeia existe uma Diretiva específica sobre o reagrupamento familiar do imigrante e toda uma gama jurisprudencial sobre a temática. Já em esfera nacional, encontram-se as normas reguladoras da imigração com suas políticas migratórias estatais, as quais regem sobre entrada e residência dos familiares dos imigrantes já admitidos. O direito a viver em família é internacionalmente resguardado, isso é cristalino diante da normatização internacional universalmente aceita. Resta saber se, em face da soberania nacional no tocante à regulação imigratória, decorre o dever inequívoco de os Estados garantirem aos imigrantes o direito dos seus familiares à entrada e residência em seus territórios. O que enseja por si só dois pontos controvertidos: quem seria esta família ou estes familiares a serem reunificados diante do âmbito jurídico, é um ponto. E, além disso, se esse reagrupamento familiar se apresenta então como um direito fundamental a ser resguardado indiscutivelmente pelos Estados, é outro particular a ser discutido neste trabalho
