In this work, we will try to find out whether, and to what extent, there should be a general clause of admissibility of procedural agreements- or, if we want, procedural conventions to make the procedure more flexible- in the Portuguese Civil Procedure and to verify the applicability of such a clause in the common declarative procedure. To this end, we will start by briefly analysing, from a theoretical perspective, judicial case management, as well as the list of typical conventions as mentioned in the NCPC. Subsequently, we will address the practical application of this principle and of these conventions in the domain of the common declarative procedure in first instance. With this task, we will verify whether the parties manage to promote, by agreement, casuistic modifications of the procedural norms or agree with the case management that is conducted in this legal framework. We will then change the paradigm and study the wide freedom of flexibilization of the Brazilian common procedure that results from the general clause of admissibility of procedural agreements provided for in the 1st part of the body of article 190 of the NCPCB. After pointing out their historical background, we will indicate the limits that Brazilian law imposes on this conventionality, study the requirements of these agreements and their legal regime and analyse the role granted to the judge in their subsequent control. We will also look at their practical application in this type and form of procedure. In the end, we will address the introduction of such a clause in the Portuguese legal order, the terms under which this should be done and their application in the common declarative procedure. After removing all the objections that could be raised to this introduction, we will conclude that it is possible to enshrine a general clause of admissibility of procedural agreements in our Civil Procedural Law. We will also realise that such a rule has a high potential for application in the common declarative procedure and, being compatible with case management, should be treated in article 547 of the NCPC. However, any voluntary flexibility will be constrained and should lead to the application of the most appropriate procedure to the specificities of the lawsuit.Neste trabalho, procuraremos saber se e em que termos deve existir, no Direito Processual Civil luso, uma cláusula geral de admissibilidade de acordos procedimentais- ou, se quisermos, de convenções processuais de flexibilização da tramitação- e indagar da aplicabilidade de uma cláusula desta génese no âmbito do processo declarativo comum. Para tal, começaremos por analisar, de forma breve e sob uma perspetiva teórica, o princípio da adequação formal e o elenco de acordos procedimentais típicos previstos no NCPC. Posteriormente, indicaremos a aplicação prática deste princípio e destas convenções no âmbito do processo declarativo comum e nos tribunais de 1ª instância. Com esta tarefa, verificaremos se as partes conseguem, por acordo, promover a modificação casuística das regras processuais ou se concordam com a flexibilização judicial conduzida nesta sede. Mudaremos então de paradigma e estudaremos a ampla liberdade de flexibilização da tramitação do procedimento comum brasileiro que advém da cláusula geral de admissibilidade de acordos procedimentais prevista na 1ª parte do corpo do art.º 190.º do NCPCB. Depois de apontarmos os seus antecedentes históricos, indicaremos os limites que o Direito Brasileiro impõe à convencionalidade nesta sede, estudaremos os requisitos destes acordos e o seu regime legal e analisaremos o papel concedido ao juiz no seu controlo posterior. Indagaremos também da sua aplicação prática neste tipo e forma de processo. Por fim, debruçar-nos-emos sobre a introdução de uma cláusula desta génese no ordenamento jurídico português, dos termos em que ela deve ser feita e da sua aplicação no processo declarativo comum. Depois de afastarmos todas as objeções que poderiam ser apontadas a esta introdução, concluiremos que é possível a consagração de uma cláusula geral de admissibilidade de acordos procedimentais no nosso Direito Processual Civil. Veremos também que que uma norma desta génese possui várias potencialidades de aplicação no processo declarativo comum, sendo compatível com a flexibilização judicial e devendo ser com ela tratada no art.º 547.º do NCPC. Contudo, qualquer flexibilização voluntária estará sujeita a limites e deverá sempre conduzir à aplicação da tramitação mais adequada às especificidades da causa
