The following thesis is the culmination of thorough research on euthanasia and its depenalization. The entire report was constructed by following a legal approach, based on the Portuguese Constitution. On this topic, there are two main contradicting jurisdictional lines of thought: on one side, who defends euthanasia, bases their argument on the ideas, values and concepts of freedom, autonomy and self-determination; opposing this line of thought, are the ones that form their reasoning on the notion of the value of human life and its inviolability. In this dissertation, the latter position was the prevalent line of thought. The role of doctors, to whom is asked to end one’s life by request, was another topic that was scrutinized. It was considered that doctors, by all means, cannot become the means to an end; and that their dignity and deontology should be respected. Furthermore, in Portugal, medical practice is founded and intrinsically connected to the Hippocratic Oath. Therefore, medical practitioners have their own legis artis, focused on protecting one’s life. The verification of the constitutionality of this research, was based on the right to life (article 24.º n.º 1 of the Portuguese Constitution), which led to the conclusion that euthanasia can be considered unconstitutional. Additionally, by taking into account article 64º. of the Portuguese Constitution, it was considered that the depenalization of euthanasia would incur in an omission of constitutionality; since in line with the right to life and the idea of medical protection, the Portuguese Government would have to heavily invest in creating palliative care that would propitiate a dignified way to face human’s life finitude. The bill about assisted dying was approved by the Parliament, and later vetoed by the President, who asked the Constitutional Court to evaluate the law, due to the legal uncertainty. The Constitutional Court analysis considered that the bill was unconstitutional, due to the lack of rigour of the legislation – especially, when defining certain terms, such as intolerable pain - which would make it difficult and problematic to apply the aforementioned bill.Este estudo sobre a problemática da eutanásia resulta de uma investigação acerca das questões suscitadas pela sua despenalização. A abordagem foi feita de um ponto de vista constitucional. Destacam-se, sobretudo, duas posições jurídicas contraditórias sobre esta matéria: por um lado, quem defende a eutanásia baseia a sua argumentação nos valores da liberdade e da autonomia e, por outro lado, os opositores da despenalização da eutanásia assentam o seu argumentário no valor da vida e da sua inviolabilidade. Nesta dissertação foi assumida a segunda posição e a ideia segundo a qual o valor da vida beneficia de prevalência perante a liberdade individual. Outra das questões abordadas foi o papel dos médicos a quem compete a execução da morte a pedido. Em abono da sua dignidade, considerou-se que os médicos não podem tornar-se meios para um fim. Mais ainda: a actividade médica assenta no juramento de Hipócrates e, assim, os médicos têm a sua legis artis orientada para a protecção e defesa da vida. A verificação da constitucionalidade que orienta esta investigação, incidiu, primeiramente, sobre o direito à vida (artigo 24.º n.º 1 da Constituição), tendo-se concluído pela eventual inconstitucionalidade material. Por outro lado, à luz do artigo 64.º da Constituição, considerou-se que a despenalização da eutanásia incorreria numa inconstitucionalidade por omissão, pois, e em nome do direito à vida e à protecção e garantia da saúde, teria de existir, o que não se verifica, um investimento sério do Estado em cuidados paliativos propiciadores de uma forma digna de enfrentar a morte natural inerente à finitude humana. A Lei da morte medicamente assistida foi, entretanto, aprovada no Parlamento, seguindo-se o veto do Presidente da República que fez um pedido de fiscalização preventiva ao Tribunal Constitucional. No seu Acórdão, sobre o qual foi realizada uma análise crítica, o Tribunal considerou a Lei ferida de inconstitucionalidades relativamente aos artigos da Lei que, de tão vagos e indeterminados, gerariam dificuldades para a sua aplicação, nomeadamente o conceito de sofrimento intolerável
