Comentarios al proyecto de ley chileno sobre protección de datos personales: deficiencias e inconsistencias en los derechos ARCO

The Chilean Congress is discussing a bill that will modify the current leg- islation on personal data protection. The General Data Protection Regulation of the European Union inspires the bill, but in some matters the legislator has decided to innovate by means of modifications that move it away from the European model. This work focuses on those aspects related to compliance with the standard of protection of personal data that was originally proposed to be achieved. This paper aims to contribute to the legislative discussion and to give an account of some of the main tools the European legislator has sought to provide data subjects for the protection of their right to informational self-determination.El Congreso chileno discute un proyecto de ley que modificará la normativa vigente en materia de protección de datos personales. El proyecto está inspirado en el Reglamento General de Protección de Datos de la Unión Europea, pero en algunas materias el legislador ha decidido innovar mediante modificaciones que lo alejan del modelo europeo. Este trabajo se enfoca en aquellos aspectos relacionadas con el cumplimiento del estándar de protección de datos personales que originalmente se proponía alcanzar. Se busca contribuir a la discusión legislativa y dar cuenta de algunas de las principales herramientas con que el legislador europeo ha querido dotar a los titulares de los datos personales para la protección de su derecho a la autodeterminación informativa
