Las condiciones de las operaciones del tránsito aduanero comunitario (TAC) en la frontera norte del estado ecuatoriano

In Ecuador, there is not enough development of research on logistics and transportation issues, and even more on community customs transit (TAC); the objetive of this research is to determine which are the conditions of community customs transit operations (TAC) in the northern border of Ecuador, focusing on providing guide to correct performance, pertinence, as well as legal gaps in the Andean community regulations. It is easy to find that, this regime presents unwanted events and failures, due in many cases to TAC particularities. Qualitative-quantitative research predominated in this research work, particular conditions of some variables that occur in the (TAC) operation were identified as well as some descriptions focused on the practice of customs regime by the cargo’s international transport companies working in the northern borderline. With the explanatory research, it was possible to verify whether the current conditions of operations carried performed in TAC affects an adequate regulatory and logistical application. From the surveys applied to 8 companies that carry out the TAC, and an objective population of 139, it was found that 75% taxes consolidation at foreign trade of this regime is carried out based on departing customs house; 50% apply the decision 837-2019 CAN, and finally, 37% express that there are cases which are not regulated at community level.En el estado ecuatoriano hay un limitadísimo desarrollo de investigaciones en temas de logística y transporte, más aún en el tránsito aduanero comunitario (TAC). El objetivo de la presente investigación es determinar las condiciones de las operaciones del TAC en la frontera norte del estado ecuatoriano; con un enfoque de proveer opciones de cómo actuar, y de ser pertinente, regular vacíos legales en la normativa comunitaria andina. Se puede evidenciar que, en la operatividad este régimen presenta eventos y falencias no deseados, debido en muchos casos a casuísticas del TAC.En este ámbito predominó la investigación cuali-cuantitativa, porque se observaron condiciones de algunas variables que se dan en la operación del TAC, y descripciones enfocadas en la práctica de dicho régimen aduanero, por parte de las empresas de transporte internacional de carga, que operan en la frontera norte. Con la investigación explicativa se verificó si las condiciones actuales de las operaciones, que se realizan en el TAC, tienen efectos en una adecuada aplicación normativa y logística. De las encuestas aplicadas a las ocho empresas habituales que realizan el TAC, de una población objetiva finita de 139, se identificó que el afianzamiento de los tributos al comercio exterior de este régimen, se realiza en base a la aduana de partida, con una aseveración del 75%; mientras que, el 50% afirmó que solamente aplican la Decisión 837-2019 CAN y finalmente el 37% manifestó que existen casos que no están normados a nivel comunitario
