La tutela delle vittime di violenza di genere e di tratta nel contesto migratorio

The paper reconstructs, in its various stages, the delineation by international and European bodies of institutions for the protection of subjects in need of shelter, fleeing from danger or the risk of suffering serious harm, by state and non-state actors, in their country of origin or provenance. The thesis deals mainly with how these subjects are received by the States, in particular how victims of gender-based violence and trafficking can, on the basis of the type of violence they have suffered or are at risk of suffering, be received and have access to a special and preferential path, based on the existence of these elements. The paper begins by first of all tracing the genesis, history and meaning of the right to asylum: it assesses how this right has gone from being a state prerogative to an institution regulated at international and European level, first of all by the 1951 Geneva Convention, which offers a minimum and shared notion of "refugee status". The paper focuses on the notion of "gender", and how this, together with "sex", have been excluded from the list of requirements necessary to be able to obtain recognition of refugee status, as governed by Article 1 letter A of the 1951 Geneva Convention. With regard to the instruments drawn up at universal level, reference is also made to the Additional Protocol of 1967, which supplements the 1951 Geneva Convention and extends the possibility of access to refugee status. The 1979 Convention on the Elimination of All Forms of Discrimination against Women and the 2011 Council of Europe Convention, signed in Istanbul, on preventing and combating violence against women and domestic violence are also analysed. At the regional level, the analysis focuses on the Common European Asylum System, and in particular on the most important Directives issued over the years on the subject, in particular the Qualification Directive 2011/95, the Procedures Directive 2013/32, and the Reception Directive 2013/33. Finally, it examines the national legislation implementing and receiving the instruments developed at universal and regional level by means of legislative decrees. The second part of the report opens with Chapter Three, which assesses the phenomenon of trafficking. It traces the documents adopted over time, from the first manifestations of the phenomenon, recognised as the "white slave trade", to the present day. The normative instruments are analysed at a universal and European level: an assessment is then made of the Italian legislation, the pillar of which is Article 18 of the Consolidated Act on Immigration of 1998, which is a forerunner and source of inspiration for international legislation. The Guidelines drawn up by the UNHCR in 2002 are considered and how in practice this document has contributed to making reception measures for trafficking victims more effective and contributed to a better identification procedure for trafficking victims. Finally, chapter three concludes with an analysis of the Nigerian trafficking system, characterised by some elements of particular interest, which pervade most cases of trafficking from that country. The thesis concludes in chapter four, which analyses some international and European case law. It evaluates the omission of the notion of trafficking in Article 4 of the ECHR and how this notion was then included, thanks to the jurisprudential elaboration of the Court, in the protection provided by the same norm. The most relevant national case law on trafficking, both of legitimacy and merit, is then reported. This analysis, therefore, shows how the protection institutions provided for by the law are applied in concrete cases, both with regard to victims of trafficking and also to refugees persecuted, for example, on account of their sexual orientation. L’elaborato ricostruisce, nelle sue varie fasi, la delineazione da parte di organismi internazionali ed europei, con di istituti di protezione di soggetti bisognosi di accoglienza, in fuga da un pericolo o dal rischio di subire un grave danno, ad opera da soggetti statali e non, nel paese di origine o di provenienza. La tesi si occupa principalmente di come questi soggetti siano accolti dagli Stati, in particolare come le vittime di violenza di genere e di tratta possano, sulla base della tipologia di violenza subita o che rischiano di subire, ottenere accoglienza e poter avere accesso a un percorso particolare e preferenziale, sulla base della sussistenza di questi elementi. L’elaborato inizia ripercorrendo anzitutto la genesi, la storia ed il significato del diritto di asilo: si valuta come questo diritto sia passato dall’essere una prerogativa statale a un istituto disciplinato a livello internazionale ed europeo, in primis dalla Convenzione di Ginevra del 1951 che offre una nozione minima e condivisa dello “status di rifugiato”. L’elaborato si concentra sulla nozione di “genere”, e su come questa, insieme al “sesso”, siano state escluse dall’elenco di requisiti necessari per poter ottenere il riconoscimento dello status di rifugiato, così come disciplinati dall’art.1 lettera A della Convenzione di Ginevra del 1951. Sempre per quanto attiene agli strumenti elaborati a livello universale, si fa riferimento al Protocollo addizionale del 1967, che va ad integrare la Convenzione di Ginevra del 1951 e ad ampliare la possibilità di accesso allo status rifugiato. Si analizza poi la Convenzione sull’eliminazione di tutte le forme di discriminazione contro le donne del 1979 e la Convenzione del Consiglio d’Europa del 2011, firmata ad Istanbul, sulla prevenzione e la lotta contro la violenza nei confronti delle donne e la violenza domestica. A livello regionale l’analisi verte sul sistema europeo comune di asilo, e in particolare sulle più importanti Direttive emanate nel corso degli anni sul tema, in particolare la Direttiva qualifiche 2011/95, la Direttiva procedura 2013/32, la Direttiva accoglienza 2013/33. Si esamina, infine, la normativa nazionale di attuazione e ricezione degli strumenti elaborati a livello universale e regionale per mezzo di decreti legislativi. La parte seconda dell’elaborato si apre con il Capitolo terzo, che valuta il fenomeno della tratta. Si ripercorrono i documenti adottati nel corso del tempo, dalle prime manifestazioni del fenomeno, riconosciuto come “tratta delle bianche”, ad oggi. Gli strumenti normativi vengono analizzati a livello universale ed europeo: è fatta poi una valutazione della normativa italiana, il cui pilastro è dato dall’art.18 del Testo Unico sull’Immigrazione del 1998, il quale è antesignano e fonte di ispirazione per la normativa internazionale. Si prendono in considerazioni le Linee Guida elaborate dall’UNHCR nel 2002 e come nella pratica questo documento abbia contribuito ad rendere maggiormente efficaci le misure di accoglienza per le vittime di tratta e contribuito a una migliore procedura di identificazione delle stesse. Infine, il capitolo terzo si conclude con una analisi del sistema di tratta nigeriano, caratterizzato da alcuni elementi di particolare interesse, che pervadono la generalità dei casi di tratta provenienti da tale Paese. La tesi si conclude al capitolo quarto, il quale analizza alcuni casi giurisprudenziali internazionali ed europei. Si valuta l’omissione della nozione di tratta all’art.4 della Convenzione EDU, e come poi questa nozione sia rientrata, grazie alla elaborazione giurisprudenziale della Corte, nella protezione prevista dalla medesima norma. Si riporta, poi, la più rilevante giurisprudenza nazionale in materia di tratta, sia di legittimità che di merito. Da tale analisi, dunque, emerge come siano concretamente applicati ai casi concreti gli istituti di protezione previsti a livello normativo, sia nei confronti delle vittime di tratta, che anche di rifugiati perseguitati, ad esempio, in relazione al proprio orientamento sessuale
