IMPLEMENTASI SISTEM PEMBINAAN LEMBAGA PEMASYARAKATAN TERHADAP NARAPIDANA TERKAIT KASUS PENYALAHGUNAAN NARKOTIKA (Studi Kasus Lembaga Permasyarakatan Kelas I Malang)

Narcotics users or addicts on the one hand are perpetrators of criminal acts, but on the other hand they are victims. Narcotics users or addicts according to law as perpetrators of narcotics crimes are the provisions of the Narcotics Law which regulates imprisonment given to perpetrators of narcotics abuse. The formulation of the problem in this research are: 1) How is the correctional system for prisoners related to narcotics abuse cases? 2) What factors influence the implementation of the Malang Class I Penitentiary system for prisoners related to narcotics abuse cases? The approach method used is the Sociological Juridical approach. The data used in this study are primary, secondary and tertiary legal materials. The author uses a qualitative descriptive analysis that describes or describes the results of the research into an in-depth article on the issues studied. Based on the results of the analysis and discussion that has been carried out, the conclusion in this study is that the correctional system for prisoners related to narcotics abuse cases is based on Law No. 35 of 2009 Article 54 which indicates that narcotics addicts and victims of narcotics abuse are required to undergo medical rehabilitation and social rehabilitation. Factors that hinder the implementation of the Malang Class I Penitentiary system for prisoners related to narcotics abuse cases, namely the capacity of the contents of the prisoners and the place is not supportive, where as many as 200 officers, staff and administration as well as the number of guards in the security section as many as 20 people while the number of prisoners is 3400 Another inhibiting factor is that there is no special training for prison officers to become rehabilitation coaches. As for the supporting factors, namely the policy for implementing PP 99 2021, namely the granting of integration rights, and regulating parole so as not to serve as many sentences as the judges sentenced so that the prison's capacity is in accordance with the proper capacity
