KONSEP CHILDFREE DALAM PERSPEKTIF MAQASHID SYARI'AH JASSER AUDA

In Indonesia, the word Childfree still sounds new and becomes controversial when a public figure like Gita Savitri, and Victoria Tunggono who openly stated that she and her husband decided not to have children or Childfree. The statement reaped pros and cons, Responding to this, The General Secretary of muhammadiyah Central Leadership Abdul Mu'ti gave the opinion that couples who choose not to have a partner is hedonistic and egoistic behavior. This study will discuss how the concept of childfree is reviewed from Maqashid Shari'ah Jasser Auda through a system approach. The system approach, is a concept that has 6 elements that are interrelated in the study of Islamic law, namely the cognitive nature of the system, wholeness, openness, hierarchy or related level, multidimensional, and also have a purpose. The results of the study showed that the concept of childfree is not completely prohibited or wrong, because every partner or woman has different and complex problems, one of which is in terms of having children. If it is associated with the system approach, then a person or partner may apply the concept of childfree as long as they have reasons that are allowed by religion and law for example not wanting to have children because they do not have stable economic conditions and the risk of instability in the household if forced to have children, or the medical authorities do not recommend to have children because if forced the risk of maternal death is higher. Regardless of whether or not chilfree may or may not be allowed, the most important thing in this concept is to keep planning with a partner to have children because actually having children is a command of Allah SWT and the Prophet (SAW). So, the concept of childfree is not applied because it follows the trend alone and as a Muslim, we are also encouraged to remind each other and provide education about things that must be prepared before having children so that household harmony is maintained when having a child
