PRAKTIK UTANG PIUTANG DENGAN JAMINAN TANAH (GADAI) DI DESA NGABLAK KECAMATAN CLUWAK KABUPATEN PATI

This study aims to determine the practice of pawning land in Ngablak Village, Cluwak District, Pati Regency and understand the reasons or motives why they have to pawn their land. So this research uses a qualitative approach. The primary data sources were taken by conducting direct interviews with both parties, both the pawner and the pawnee, while the secondary data sources were obtained by means of a literature study. Based on the results of the study, the implementation of land pawning in Ngablak Village, Cluwak District, Pati Regency still uses the customary legal system. Starting from determining the price of the land pawn, the period of the pawn, the process of making the agreement which is still using verbally and how to return the land pledge. In addition, the motive for the implementation of this pawn varies from personal needs to the needs of his family, where in the implementation of this land pawning is done when it is urgent. In the implementation of land pawning in Ngablak Village, there are still those that are carried out for more than 7 years which has violated the provisions of Law Prp No.56 of 1960 concerning the determination of agricultural land area
