KEJAHATAN TERHADAP KEMANUSIAAN YANG DILAKUKAN OLEH MILITER PADA KUDETA MILITER MYANMAR MENURUT HUKUM HAM INTERNASIONAL

Start from February 1, 2021, the Military under the leadership of Min Aung Hlaing took over the elected government through the November 2020 election results, declared the country a state of emergency and then the military started a coup in Myanmar and carried out arbitrary acts aimed at Myanmar civilians in the form of acts that led to on crimes against humanity. The purpose of this research is to find out the forms of human rights crimes that occurred during the Myanmar military coup as seen from International Human Rights Law and what efforts can be made by Myanmar citizens to stop the human rights violations that occurred during the coup in Myanmar. The research method used in reviewing this case is by using empirical legal research methods. This study found that during the military coup of Myanmar, the military did everything it could to stop protesters protesting against the new government, such as carrying out killings, torture, enforced disappearances, and arbitrary deprivation of liberty such as detention and imprisonment for no apparent reason. Then the Myanmar people did not stay silent, there was a local NGO that always reported the data they got, especially related to victims of crimes committed by the Myanmar military against Myanmar civilians and residents joined the National Unity Government of Myanmar (NUG) in their steps to prevent the crime from targeting them again. When viewed from the perspective of international human rights law as stated in Article 7 paragraph (1) of the 1998 Rome Statute that the Myanmar military has fulfilled all the elements where there are acts that can be said to be crimes against humanity, namely the Myanmar military carried out attacks on civilians, then the attacks were carried out. widely and systematically. Myanmar actually has to learn from events that have happened in the past so that incidents like this military coup do not happen again in the future by improving its government system and starting to ratify various conventions that can help resolve if an incident like this happens again
