Les Eigenleute de Franconie aux XIIIe-XVe siècles : Essai d'appréhension spatiale et sémantique d'une catégorie sociale malmenée

The historiography of late medieval Franconian serfdom is characterized by flagrant contradictions among historians (Is serfdom general or residual? Is it reinforced or rather waning during the late Middle Ages?). There is also a great imprecision of the terminology employed, as historians have the custom of assimilating the ensemble of medieval terms, both Latin and German (servi, servitus, homines proprii, eigene Leute, Leibeigene, Leib und Gut, etc.), into a single phenomenon, designated as Leibeigenschaft and characterized by the absence of freedom of movement and a strict control over marriage and the transfer of goods. Therefore it is necessary to re-evaluate the question at its most basic levels, that is, both the terminology used in the sources and the corresponding social relations.This contribution intends to demonstrate that the abandonment of a substantialist perspective on serfdom and the adoption of a precise, lexicometric, and cartographic examination of the terminology and its uses in space and time are likely to lead to a radical change in the explicative paradigm. The study begins with the examination of the key word from the documents: eigenleute (in Latin homines proprii), which is used far more frequently than any other designation (although historians systematically tend to transform it into Leibeigene — homines de corpore). The examination of its uses brings to light two phenomena. First, the term has a very unequal spatial distribution: it is unknown in eastern Franconia, although there is no reason to believe that the situation of dependents was any better there. Second, the term is very frequently used in combination with eigengüter (allod), as opposed to lehen (fief or tenure). The way these two terms are employed together forces us to consider that the prefix eigen- has the same meaning in the two. But research into an eventual signification of eigenleute leaning on the allodial character of eigengüter only leads to incoherence, which demonstrates the limitations to legalistic readings of these categories. This conjoined use makes more sense once it is correlated with the unequal spatial distribution of the term eigenleute, which itself corresponds very neatly to the distribution of Weistümer (customary law, i.e. acknowledgments of lordly rights in a precise locality, taken by the dependent inhabitants of the locality), which are practically absent in eastern Franconia. For the social sense of these acknowledgments has been recently re-evaluated: far from primarily regulating relations between lords and their dependents, they served to organize, on the local level, relations among lords (remembering that villages always included several lords), and thus to reproduce interlordly cohesion through the organization of their relations with dependents. By examining the category of eigenleute from this angle, it becomes apparent that its use is essentially linked to situations of articulation and hierarchisation of the diverse powers of lords on the same dependent. The category of eigenleute appears thus not as a reference to a substantially servile status but as the expression of the pre-eminence of a particular lord, in contrast to others, over people (and their goods) — without any indication of the contents, which were variable, of the powers founding this pre-eminence. This examination thus makes the variations of the use of the word eigenleute comprehensible both in space (the interlord structure in Franconia differed sharply between its western and eastern parts, because in the east a dependent never had more than one lord — and there was thus no need to create a hierarchy among concurrent powers through the category of eigenleute) and in time (the disappearance of the use of the word signalled not the liberation of the population, but rather the emergence of local lordly monopolies). Thus, serfdom should probably be studied less in terms of the relation between lord and dependent, and more in terms of the relations among lords concerning their dependents. In the most general way, the case of eigenleute demonstrates that a legal and substantialist reading of medieval social categories (here, those that supposedly designate ‘serfs') can only result in misinterpretations and/or contradictions.L'historiographie du servage (Leibeigenschaft) franconien à la fin du Moyen Âge se caractérise par l'existence de contradictions flagrantes entre historiens (sur le caractère généralisé ou au contraire résiduel du servage, ainsi que sur son renforcement ou au contraire sa disparition à la fin du Moyen Âge) et par une grande imprécision de la terminologie employée : les historiens ont coutume de ramener l'ensemble des termes médiévaux, latins ou allemands (servi, servitus, homines proprii, eigene Leute, Leibeigene, Leib und Gut, etc.), à un unique phénomène, désigné comme Leibeigenschaft et caractérisé par l'absence de liberté de mouvement et un contrôle strict du mariage et de la transmission des biens. Il a donc semblé nécessaire de reprendre la question à la base, c'est-à-dire à la fois au niveau de la terminologie des sources et des rapports sociaux auxquels elle correspond. Cette contribution entend montrer comment l'abandon d'une perspective substantialiste du servage et l'examen précis, lexicométrique et cartographique, de la terminologie et de ses usages dans l'espace et dans le temps sont susceptibles de conduire à un changement radical de paradigme explicatif. Cette expérience est menée à partir de l'examen du syntagme clé de la documentation : eigenleute (en latin homines proprii), qui représente la désignation de très loin la plus couramment employée (bien que les historiens tendent systématiquement à la transformer en Leibeigene – littéralement « hommes de corps »). L'examen de ses usages fait apparaître deux phénomènes : d'une part une très inégale répartition spatiale, la Franconie orientale l'ignorant complètement (alors que rien ne permet de supposer que la situation des dépendants y ait été meilleure) ; d'autre part un usage en très fréquente combinaison avec eigengüter, habituellement traduit par « alleu » (par opposition à lehen, « fief » ou « tenure »). La manière dont les deux termes sont employés ensemble impose de considérer que le segment eigen- a le même sens dans les deux syntagmes. Mais la recherche d'une éventuelle signification d'eigenleute à partir du caractère allodial d'eigengüter n'aboutit qu'à des incohérences, qui montrent bien les limites d'une lecture juridiste de ces catégories.Cet usage conjoint prend tout son sens dès lors qu'on en corrèle l'examen à celui de la distribution spatiale inégale, laquelle correspond très étroitement à celle des Weistümer (« aveux » de droits seigneuriaux dans une localité précise, effectués par des dépendants habitant la localité), pratiquement absents de Franconie orientale. Or le sens social de ceux-ci a été dernièrement réévalué : loin de viser d'abord une régulation des rapports entre seigneur et dépendants, ils servent à organiser localement les rapports entre seigneurs (sachant que les villages comptent toujours plusieurs seigneurs), et donc à reproduire la cohésion inter-seigneuriale, à travers l'organisation de leurs rapports avec les dépendants. En examinant la catégorie eigenleute sous cet angle, on se rend alors compte que son emploi renvoie essentiellement à des situations d'articulation et de hiérarchisation de divers pouvoirs seigneuriaux sur un même dépendant. La catégorie eigenleute apparaît ainsi non comme renvoyant à un état substantiellement servile mais comme l'expression de la prééminence d'un seigneur, face à d'autres, sur des personnes (et leurs biens) – sans que rien soit dit quant au contenu, variable, des pouvoirs qui fondent cette prééminence.Ceci rend alors compréhensibles les variations de l'usage du syntagme à la fois dans l'espace (la structuration inter-seigneuriale en Franconie diffère nettement entre les parties occidentale et orientale dans la mesure où à l'est, un dépendant n'a jamais qu'un seigneur – et il n'est donc pas besoin de hiérarchiser des pouvoirs concurrentiels par le recours à la catégorie d'eigenleute) et dans le temps (la disparition de l'emploi du syntagme signalant non pas une libération de la population, mais plutôt l'apparition d'une situation de monopole seigneurial local). Le servage devrait ainsi sans doute être étudié moins en tant que rapport entre seigneur et dépendant qu'en tant que rapport entre seigneurs à propos de dépendants. De manière plus générale, le cas des eigenleute montre qu'une lecture juridiste et substantialiste des catégories sociales médiévales (en l'occurrence celles qui sont censées désigner des « serfs ») ne peut qu'aboutir à des contresens et/ou des contradictions
