The crime of disorderly conduct

This thesis deals with the issue of the crime of disorderly conduct, which is one of the offences against public order covered in the title tenth of the special part of the Criminal Code. In accordance with provision of the section 358 of the Criminal Code disorderly conduct is defined as committing a gross impropriety or disturbance in public or in a publicly accessible place. Primarily this wide formulation of the body of a crime using vague concepts makes crime of disorderly conduct so questionable. The content of this thesis is divided into seven chapters in order to outline both current and past issues related to the crime of disorderly conduct and evaluate the changes that have taken place in this field. The first chapter focuses on the historical development of legislation in the territory of the Czech Republic from 1852 up to the Criminal Code of 1961. Second chapter continues with the analysis of current legal regulation of the crime of disorderly conduct. The emphasis is placed on mentioned vague concepts and their interpretation which can cause difficulties in practice. Next chapter deals with possible concurrence of the crime of disorderly conduct with other criminal offences which use to happen in practice very often.
