This paper shows the fundamental characteristics of two international instruments issued by the United Nations: the Manual on the Effective Investigation and Documentation of Torture, Cruel, Inhuman or Degrading Treatment or Punishment, and the Minnesota Protocol on the Investigation of Potentially Wrongful Deaths. Then, presents and analyzes the arguments by which the Inter-American Court of Human Rights has held that these international documents are <<applicable>> to the member states of the Latin American System of Human Rights Protection. Finally, presents a critical review of that position of the Inter-American Court of Human Rights, using the conceptual tools of the rationalist theory of proof.El presente trabajo present...
