On the effectiveness of the Istanbul and Minnesota protocols in the jurisprudence of the Inter-American Court of Human Rights.

This paper shows the fundamental characteristics of two international instruments issued by the United Nations: the Manual on the Effective Investigation and Documentation of Torture, Cruel, Inhuman or Degrading Treatment or Punishment, and the Minnesota Protocol on the Investigation of Potentially Wrongful Deaths. Then, presents and analyzes the arguments by which the Inter-American Court of Human Rights has held that these international documents are <<applicable>> to the member states of the Latin American System of Human Rights Protection. Finally, presents a critical review of that position of the Inter-American Court of Human Rights, using the conceptual tools of the rationalist theory of proof.El presente trabajo presenta las características fundamentales de dos instrumentos internacionales emitidos por la Organización de las Naciones Unidas: el Manual de Investigación y Documentación Efectiva sobre Tortura, Castigos y Tratamientos Crueles, Inhumanos o Degradantes, más conocido como «Protocolo de Estambul», y el Protocolo de Minnesota sobre la Investigación de Muertes Potencialmente Ilícitas. Luego, presenta y analiza los argumentos por los cuales la Corte IDH ha sostenido que esos documentos internacionales resultan vinculantes para los Estados miembros del sistema latinoamericano de protección de Derechos Humanos. Por último, realiza una serie de críticas a la posición de la Corte IDH valiéndose para ello de las herramientas conceptuales de la teoría racionalista de la prueba
