Comparison of the Nature Conservation Legislation and Enforcement in Spain and Iceland

Náttúruverndarlöggjöfin á Spáni þurfti að fara í gegnum gagngerar breytingar eftir að hæstiréttur Spánar hafði úrskurðað að stjórn þjóðgarða og annarra náttúruverndarsvæða bæri að vera í umsjón sjálfstjórnarsvæða. Niðurstaðan voru tvenn lög, ný náttúruverndarlög 42/2007 og lög um þjóðgarða 30/2014, en markmið laganna er að tryggja samræmda löggjöf án þess að skerða völd sjálfstjórnarsvæða. Á Íslandi fór fram heildræn endurskoðun á löggjöf um náttúruvernd á árunum 2009 og 2010. Niðurstaðan voru ný lög um náttúruvernd nr. 60/2013. Nefndin sem hafði unnið að endurskoðun laganna hafði löggjöf Norðurlandanna og sér í lagi nýju náttúruverndarlögin í Noregi sér til fyrirmyndar. Náttúruvernd er hnattræn áskorun og þekkir engin landamæri. Í ritgerð minni er gerður samanburður á löggjöf, stjórn og eftirliti með náttúruverndarsvæðum á Spáni og Íslandi og leitað svara við þeirri spurningu hvort við gætum lært hvort af öðru. Helsti kostur spænsku laganna er skilvirkni þeirra, þar sem náttúruverndarlög og þjóðgarðalög hafa það hlutverk að samræma og setja lagalegan ramma. Helstu stjórnunartól verndarsvæða eru skilgreind í spænskum lögum og lögð er áhersla á samráð, svæðisskiptingu og félagshagfræðileg áhrif verndunar. Á Íslandi gerir fjöldi sérlaga á sviði náttúruverndar og mismunandi útfærslur á framkvæmd og eftirliti með verndarsvæðum allar breytingar seinvirkar. Hér getum við lært af spænsku löggjöfinni með því að setja lög sem samræma og setja lagalegan ramma fyrir öll verndarsvæði en efla vald heimamanna og stjórnar hvers verndarsvæðis.The Nature Conservation Legislation in Spain needed to be completely changed after the Constitutional Court of Spain had decided that the management of the national parks and other protected areas should be in the hands of the autonomous communities. The result were two new laws: the Law on Natural Heritage and Biodiversity 42/2007 and the National Parks Act 30/2014. Both laws aimed at coordinating the legislation without taking the power of enforcement out of the hands of the autonomous communities. In Iceland a comprehensive revision of the legislation on nature conservation took place in 2009-2010. The result of the revision was the Nature Conservation Act 60/2013. The revision committee used as reference the legislation of the Nordic Countries and especially the new Nature Diversity Act of Norway. Nature conservation is a global challenge and does not recognise borders. In this thesis I compare the legislation, management and monitoring of protected areas in Spain and in Iceland and look for the answer to the question wether we could learn from each other. The main advantage of the Spanish laws is their efficiency. Both the Law on Natural Heritage and Biodiversity and the National Parks Act aim at coordination by creating a legal framework. The laws define the main tools for conservation and emphasis is placed among others on consultation, zoning and the socioeconomic impact of conservation. In Iceland the number of special laws on nature conservation and the different implementation of management and monitoring of the protected areas make all changes working slow. In this way we can learn from the Spanish legislation by passing laws that help coordinate and set a legal framework for all protected areas and in the same time strengthen the power of enforcement of the local population and the administration of each protected area
