Perspectiva de género en la decisión judicial: justificación y metodología

The text that is presented inquires about the role of the judge in the achievement of material equality and the elimination of injustices linked to gender and the way in which a gender approach and the guidelines that emerge from there contributes to the fulfillment of that role. To answer this question, the analysis focuses on the contributions that, in theoretical terms, research on gender and the administration of justice has generated and then exposes the way the gender approach guides, as an analysis methodology, judicial practice. The result that is presented describes the findings of a theoretical investigation, based on the critical hermeneutic paradigm, from the analysis of documentary sources approached from the technique of analytical review and discourse analysis. As a result of the proposed analysis, it is concluded that to the extent that obstacles persist for women to access the administration of justice in fair conditions, the relevance and justification of incorporating guiding criteria of the differential gender approach is pertinent to achieve judicial decisions that are more guaranteeing of material equality.El texto que se presenta indaga acerca del papel del juez frente al logro de la igualdad material y la eliminación de las injusticias ligadas al género y la forma en que el enfoque de género y las directrices que de allí se desprenden pueden contribuir con el cumplimiento de ese papel. Para dar respuesta a esa pregunta, el análisis se centra en los aportes que en términos teóricos ha generado la investigación sobre género y administración de justicia para luego exponer la forma en que el enfoque de género orienta, como metodología de análisis, la práctica judicial. El resultado que se presenta describe los hallazgos de una investigación teórica, desde el paradigma hermenéutico crítico, a partir del análisis de fuentes documentales abordadas desde la técnica de la reseña analítica y el análisis del discurso. Como resultado del análisis propuesto se concluye que en la medida en que subsisten obstáculos para que las mujeres accedan a la administración de justicia en condiciones equitativas, es pertinente y se justifica incorporar criterios orientadores del enfoque diferencial de género con el fin de lograr decisiones judiciales más garantistas de la igualdad material.&nbsp
