El protocolo de reconocimiento de medios digitales frente a la inobservancia del debido proceso penal

The recognition of digital information incorporates facts to the investigation in the prosecutorial investigation stage, to later present it at trial as evidence, where there is evidence of non-compliance with procedural rules: no judicial authorization is requested, no private hearing is held, and the parties to the proceedings do not attend. From this perspective, the objective of the study was to analyze the protocol of recognition of videos, computer data, photographs, disks or other digital media and the non-observance of due process. The research was exploratory, descriptive and a case study of the sentences of the First Court of Criminal Guarantees of Cañar. The judges in the sentences did not value the expert testimony, considering it unlawful evidence, because it violates the fundamental right to due process, in a very significant percentage of 85% of the cases investigated, therefore, the rigorous technical evidence was reduced to solve the criminal conflict. El reconocimiento de información digital incorpora hechos a la investigación en la etapa de instrucción fiscal, para luego presentarla en juicio como prueba, donde se evidencia el incumplimiento de reglas procesales: no se solicita autorización judicial, no se lleva a cabo audiencia privada, no asisten las partes procesales. Desde esta perspectiva el objetivo del estudio fue analizar el protocolo de reconocimiento de videos, datos informáticos, fotografías, discos u otros medios digitales y la inobservancia del debido proceso. La investigación fue exploratoria, descriptiva y el estudio de caso de las sentencias del Tribunal Primero de Garantías Penales del Cañar. Los jueces en las sentencias no valoraron el testimonio pericial, al considerarla prueba ilícita, porque vulneran el derecho fundamental al debido proceso, en un porcentaje muy significativo del 85%, de los casos investigados, por ello, se menguó la prueba técnica rigurosa para solucionar el conflicto penal
