PENYELESAIAN SENGKETA HARTA BERSAMA YANG DIJAMINKAN DAN DIPERJUALBELIKAN TANPA SEPENGETAHUAN MANTAN SUAMI (Studi Kasus Di Desa Durensewu Kecamatan Pandaan)

ABSTRACT In a marriage if it fails to build a household it will lead to divorce, divorce certainly has consequences for assets, especially joint property, departing from this the researcher raises the issue of Settlement of Disputes on Joint Assets that are Guaranteed and Traded Without the Knowledge of the Ex-Husband (Case Study in Durensewu Village Pandaan District). The choice of the theme was motivated by the problems that occurred in the village of Durensewu, there was a husband and wife who divorced for a long time but their joint assets were guaranteed and traded by the ex-wife without the knowledge of the ex-husband. Because the dispute did not end, one of the parties asked the Village Head to mediate the dispute. Both parties use the mediation route because it is considered more efficient than using the court process. This research is an empirical juridical law research using a sociological juridical approach. Furthermore, the data obtained were reviewed and analyzed with the approaches used in the research to answer the legal issues in this study. According to the Marriage Law and the Compilation of Islamic Law, joint property is property that is during the marriage period. In Islamic law, it does not recognize the mixing of assets into joint assets, but it is permissible to make a marriage agreement before the marriage contract is carried out. This dispute resolution process uses a mediation route where the Village Head acts as a mediator. The result of mediation is that the object of the dispute has already been sold by the ex-wife, so the money from the sale of the object of the dispute is divided by 70% given to the ex-husband because the construction of the house without the intervention of the ex-wife and the ex-husband also gets child custody, while the ex-wife gets a 30% share of the sale of the disputed object.Key words: Dispute Resolution, Mediation, and Joint Assets ABSTRAK Dalam sebuah perkawinan jika gagal membina rumah tangga maka akan berujung pada perceraian, perceraian tentu memiliki akibat terhadap harta kekayaan khususnya harta bersama, berangkat dari hal tersebut peneliti mengangkat permasalahan Penyelesaian Sengketa Harta Bersama Yang Dijaminkan Dan Diperjualbelikan Tanpa Sepengetahuan Mantan Suami (Studi Kasus Di Desa Durensewu Kecamatan Pandaan). Pilihan tema tersebut diletar belakangi oleh permasalahan yang terjadi di desa durensewu terdapat sepasang suami istri yang bercerai lama tetapi harta bersama mereka dijaminkan serta diperjualbelikan oleh pihak mantan istri tanpa sepengetahuan mantan suami. Karena sengketa tak kunjung usai, maka salah satu pihak meminta Kepala Desa untuk memediatori sengketa tersebut. Kedua belah pihak menggunakan jalur mediasi karena hal tersebut dianggap lebih efisien dari pada menggunakan proses pengadilan. Penelitian ini merupakan penelitian hukum yuridis empiris dengan menggunakan pendekatan yuridis sosiologis. Selanjutnya data yang diperoleh dikaji dan dianalisis dengan pendekatan-pendekatan yang digunakan dalam penelitian untuk menjawab isu hukum dalam penelitian ini. menurut Undang-Undang perkawinan dan Kompilasi Hukum Islam, harta bersama adalah harta yang berada dalam masa perkawinan. Dalam hukum Islam tidak mengenal adanya pencampura harta kedalam harta bersama akan tetapi dibolehkannya membuat perjanjian perkawinan sebelum dilakukannya akad perkawinan. Proses penyelesaian sengketa ini menggunakan jalur mediasi dimana Kepala Desa bertindak sebagai mediator. Hasil dari mediasi adalah objek sengketa sudah terlanjur dijual oleh pihak mantan istri maka uang hasil penjualan dari objek sengketa tersebut dibagi dengan 70% diberikan kepada mantan suami dikarenakan pembangunan rumah tersebut tanpa campur tangan pihak mantan istri serta pihak mantan suami juga mendapatkan hak asuh anak, sedangkan pihak mantan istri mendapatkan 30% bagian dari penjualan objek sengketa tersebut.Kata Kunci: Penyelesaian Sengketa, Mediasi, dan Harta Bersam
