PERLINDUNGAN KONSUMEN TERHADAP HAK KONSUMEN SAAT DEVELOPER GANTI KEPEMILIKAN (Studi Di PT Metsuma Anugrah Graha Gresik)

ABSTRACT In Law Number 8 of 1999 concerning Consumer Protection, in practice there are still violations of these regulations, and deviations from these regulations, especially in Article 4 Letter (b). Because at the post-transaction stage the promised guarantee is not kept by the business actor, the consumer has the right to obtain the goods and/or services in accordance with the promised guarantee, namely obtaining a Certificate of Ownership (SHM). The purpose of this research in general is to examine how consumers protect consumer rights, the application of Article 4 Letter (b) of the Consumer Protection Act, as well as the obstacles or obstacles experienced by business actors in carrying out their responsibilities to consumers. Based on the results of the research, it can be concluded that the application of Article 4 Letter (b) of the Consumer Protection Act related to the right as a consumer to obtain goods and/or services according to the promised guarantee, which is stated in the contract agreement has not been implemented properly by the developer PT MAG.Keywords : Consumer, Consumer Protection, Consumer Rights, Agreement. ABSTRAKDalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, pada prakteknya masih terjadi pelanggaran mengenai peraturan tersebut, dan penyimpangan dari peraturan tersebut khususnya pada Pasal 4 Huruf (b). Karena pada tahap purnatransaksi jaminan yang dijanjikan tidak ditepati oleh pelaku usaha, maka konsumen mempunyai hak untuk mendapakan barang dan/atau jasa tersebut sesuai dengan jaminan yang dijanjikan yaitu memperoleh Sertifikat Hak Milik (SHM). Tujuan penelitian ini secara umum untuk meneliti bagaimana perlindungan konsumen terhadap hak konsumen, penerapan Pasal 4 Huruf (b) Undang-Undang Perlindungan Konsumen, serta hambatan-hambatan atau kendala yang dialami oleh pelaku usaha dalam melaksanakan tanggung jawabnya terhadap konsumen. Berdasarkan hasil penelitian, maka dapat ditarik kesimuplan, bahwa penerapan dari Pasal 4 Huruf (b) Undang-Undang Perlindungan Konsumen terkait hak sebagai konsumen untuk mendapatkan barang dan/atau jasa sesuai jaminan yang dijanjikan, yang dinyatakan dalam kontrak perjanjian belum terlaksana dengan baik oleh developer PT.
