KAJIAN TERHADAP HAK MILIK ATAS TANAH YANG TERJADI BERDASARKAN HUKUM ADAT

ABSTRACTArticle 22 Number 5 of 1960 states that land ownership rights can be issued based on customary law and procedures for the issuance of property rights are regulated by Government Regulations. But in fact the regulation has not yet been enforced, so this has led to some differences of opinion in issuing property rights to land. Therefore, what is the legal basis for the issuance of property rights to land based on customary law and what is the position of property rights on the land based on its issuance. So to answer these questions will be carried out on relevant laws, doctrines and previous research. Sehun shows that the legal basis for the issuance of these rights are the customary principles contained in customary law, the value of customary law in that place. In essence, ulayat property rights have the same position as property rights issued based on government decisions, the difference is in the proof of ownership rights to certificates of rights issued based on government decisions but land owned by ulayat rights, namely evidence of physical owner and ulayat property rights. . Recognition from people who live in the place where the right is issued as well as customary recognition.Keywords: Right of Land, Customary Law.ABSTRAK Dalam Pasal 22 Nomor 5 Tahun 1960 dituliskan bahwa hak milik atas tanah dapat diterbitkan berdasarkan hukum adat serta tata cara penerbitan hak milik yang diatur berdasarkan Peraturan Pemerintah. Tapi pada kenyataanya peraturan tersebut belum juga diberlakukan sehingga hal ini menimbulkan beberapa perbedaan pandangan dalam mengeluarkan hak milik atas tanah. Oleh sebab itu, maka apa dasar hukum tentang penerbitan hak milik atas tanah berdasarkan hukum adat serta bagaimana kedudukan hak milik atas tanah tersebut berdasarkan penerbitannya. Maka untuk menjawab pertanyaan tersebut akan dilakukan terhadap undang-undang, doktrin dan penelitian sebelumnya yang relevan. Sehingga menunjukkan bahwa dasar hukum dikeluarkannya hak tersebut adalah asas-asas adat yang terdapat dalam hukum adat, nilai hukum adat di tempat tersebut. Pada hakekatnya hak milik ulayat mempunyai kedudukan yang sama dengan hak milik yang diterbitkan berdasarkan keputusan pemerintah, yang menjadi pembeda adalah pada bukti hak milik atas sertifikat hak yang diterbitkan berdasarkan keputusan pemerintah tetapi tanah yang dimiliki oleh hak ulayat yaitu bukti pemilikan fisik dan hak milik secara ulayat. Pengakuan dari orang-orang yang tinggal di tempat di mana hak itu dikeluarkan maupun pengekuan secara adat.Kata Kunci: Hak Atas Tanah, Hukum Adat
