Pelaksanaan Pengajuan Perkara Dispensasi Kawin Menurut Peraturan Mahkamah Agung Nomor 5 Tahun 2019 (Studi Kasus Di Pengadilan Agama Bangkinang)

In Indonesian law, the rules regarding the minimum limit for marriage are regulated in Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, in which it is stated that men and women must both reach the age of 19 years. If there is an urgent matter that requires a child to get married while he is not old enough, then it must be legalized with a marriage dispensation granted by the court. To follow up on this, the Supreme Court then issued PERMA Number 5 of 2019 concerning Handling of Marriage Dispensation Cases. The main problem in this research is how to apply for a marriage dispensation case at the Bangkinang Religious Court and how to review Perma Number 5 of 2019 on the implementation of a marriage dispensation case at the Bangkinang Religious Court. This study uses the legal research method of observation (Observational research), which is descriptive analytical. The data collection tool in this study was through observation, interviews and literature studies relating to the Filing of Marriage Dispensation Cases according to Supreme Court Regulation Number 5 of 2019 at the research location, namely the Bangkinang Religious Court. From the results of the study, it is known that the application of the marriage dispensation case at the Bangkinang Religious Court is submitted electronically through the e-court application. According to the PERMA review no. 5 of 2019 in the event that both parents are divorced, the PERMA does not fulfill what is meant by the PERMA, as well as in filing cases for prospective husbands and wives who are both underage, the principles of simple, fast and low-cost justice are also not met.
