Politik Hukum Pemilihan Ketua Umum Partai Politik Dalam Sistem Ketatanegaraan Di Indonesia (Analisis Konflik Dualisme Partai Golkar Dan PPP)

This research is motivated by internal party problems with the general chairman of political parties due to the general chairman of political parties holding the highest authority. If the chairperson of a political party is not appropriate in its decision it will negatively impact the continuity and harmonization within the membership of a political party. The problem is required by a Chairman of a Political Party who not only has the elektabilitas but has a sense of responsibility and sacrifice to the party he leads so that the conflict problems caused by the result of the Munas decision should be considered by the Chairman of the Political Party. On the contrary, if the Chairperson of the Political Party insists on and maintains its own opinion, it does not provide a solution to the future of the Political Party itself. In other words, it takes the wisdom and wisdom of the General Chairman of Political Parties. The main issues in this research are (1) how is the application of democratic principle in the succession of election of Golkar Party Chairman and PPP (2) what is the implication of dualism conflict between Golkar Party and PPP in Indonesian state administration system. The method used by law research normatively in examining this case, which is a study conducted by reviewing all laws and regulations relating to legal issues under investigation. The results stated that the application of democratic principles in the succession of the election of Golkar Party and PPP Chairman, that democratization does not occur in the stewardship. This is evidenced by the occurrence of pros and cons of management that ended into the general judicial process, which actually makes the problems between the two stewardship getting worse. Negotiation steps are simply ignored because of individual and counter-principle wishes in the spirit of the General Chairman who claim each other's legitimate position. The above legal facts illustrate that there has been no democratization within the party stewardship. Because the chaotic party actually makes the party conditions worse off. The overwhelming seizure of seats in the Chairman's seat becomes a real conflict of two hostile parties. The implications of the dualism conflict between Golkar Party and PPP in the Indonesian state administration system that the party chairman's problem actually impact on the mechanism of nomination of regional head and the role of political party. Because the political party provides a very strong role to be able to carry out Pilkada simultaneously.
