Pelaksanaan Pewarisansako (GALA) Di Kanagarian Sungai Tarab Kecamatan Sungai Tarab Kabupaten Tanah Datar

Customary law is an unwritten law recognized in the Constitution. One group of Minangkabau indigenous people who still adhere to their customs and their customary law is he indigenous Kanagarian Sungai Tarab. Sungai Tarab indigenous people are people whose customs are still thick which is located in Tanah Datar District, West Sumatra province. Pewarisan is one of the customary laws that is still carried out and followed by Sungai Tarab ndigenous people to this day which in the Sungai Tarab indigenous people there is an ntangible inheritance calledsako (gala).The implementation of inheritance ofsako (gala)in kanagarian Sungai Tarab is carried out in accordance with the prevailing customary provisions of their ancestors, all of which are gradual and continuous processes. The main problem in this research is how the implementation of inheritance ofsako (gala)in Kanagarian Sungai Tarab Sub-district of Sungai Tarab, Tanah Datar Regency, how he obstacles arise in the implementation of inheritance ofsako(gala)in Kanagarian Sungai Tarab Sub-district Sungai Tarab, Tanah Datar District. The type of research used in this study is observational research, namely by surveyinor directly reviewing the location of the study using the interview method as a basicdata collection tool. While based on the nature of this research is descriptive, namely the authors provide a detailed, clear, and systematic description of the main problem of the research. Based on the results of the research conducted by the author, that the inheritance system in Sungai Tarab indigenous people is based on the matrilineal system of inheritance which is based on the maternal lineage in which inheritance ofsako (gala) is inherited from niniak descending ka mamak, from mamak descending ka kamanakan. Which in its mplementation takes 3 to 5 days from selecting candidates to replace the prince in the circle of the people, calling for the Nagari, fulfilling the administration of KAN, until the process of disillusioning thegala, the event at theRumah Gadang, which ends with maurak selo. The obstacle faced in the implementation of sako (gala) in Kanagrian Sungai Tarab is the existence of a dispute from the people concerned, the cost and unwillingness of the candidate o become the headman or theheiress(gala)
