Intersectional theses add, among other conditions, race, gender and class as forms of oppression. More recently, intersectional anti-capacity reflections have emerged, so named for incorporating oppression against people with disabilities into intersectionality. The objective of the article is to systematize in legal and political terms the relevance of this epistemic expansion. For this, the social concept of racism based on Achille Mbembe will be analyzed as a constitutive element of multiple discrimination. Brazilian legislation and jurisprudence will be shown as normative frameworks for the acceptance of these theses to face racism and structural ableism in Brazil.
