Discurso do ódio nas redes sociais no Brasil : análise da possibilidade e legitimidade de controle legislativo, administrativo e judicial ante o tratamento constitucional e internacional

The hate speech violates the dignity of the human person and disable the participation in democratic spaces of debate. Social networks increase their power, through the speed of information, the lack of bordersand and the provided public dimension, turnning up a propitious scenario for the dissemination of hate speech. Faced with this situation, is it possible to have greater control over the hate speech practiced on social networks, so as to safeguard in the digital environment the same rights and duties that citizens have offline? The research aims to analyze whether it would be possible to restrict freedom of expression according to hate speech in social networks and, if so, whether such regulation would take place through legislative, administrative and/or judicial routes. Thus, we will analyze the foreign experience regarding the treatment of hate speech, focused on the two main models: the american and the german. In the perspective of the binary code of law, hate speech is not a legitimate exercise of freedom of speech, but rather an illicit one. The non-regulation of hate speech in social networks is a violation, by omission, of human rights, especially communicative rights, based on the Constitution and international human rights instruments. The philosophical dimension necessary to the debate, based on the discussions of contemporary law philosophers Ronald Dworkin and Jeremy Waldron on the prohibition of hate speech and its consequences for the legitimacy of political discussion, is essential in order to provide clear and cohesive patterns of restrictions to freedom of speech in the context of the hate speech in social networks, being restricted to the cases in which it is not possible the later composition of the damage. Consequently, the constitutional and internationally appropriate treatment is the impossibility of prior censorship, becoming, however, the author of the speech responsible for the abuses he commits. A qualitative exploratory-descriptive research on freedom of expression, network society, hate speech, legislative and judicial control was used.O discurso do ódio vulnera a dignidade da pessoa humana e impossibilita a participação em espaços democráticos de discussão. As redes sociais ampliam o seu poder, pela velocidade das informações, falta de fronteiras e dimensão pública proporcionada, tornando-se um campo propício para a disseminação dos discursos do ódio. Diante disso, é possível um maior controle sobre o discurso do ódio praticado nas redes sociais, de modo a resguardar no meio ambiente digital os mesmos direitos e deveres que os cidadãos têm offline? A pesquisa tem por objetivo analisar se seria possível uma restrição por meio de instrumentos jurídicos da liberdade de expressão, em função dos discursos de ódio nas redes sociais e, em caso positivo, se essa regulamentação ocorreria pelas vias legislativa, administrativa e/ou judicial. Assim, analisar-se-á a experiência estrangeira quanto ao tratamento do discurso do ódio, centrada nos dois principais modelos: o americano e o alemão. Na perspectiva do código binário do direito, o discurso do ódio não constitui exercício legítimo da liberdade de expressão, mas sim ilícito. A não regulamentação do discurso do ódio nas redes sociais constitui violação, por omissão, dos direitos humanos, especialmente os comunicativos, à luz da Constituição pátria e dos instrumentos internacionais de direitos humanos. A dimensão filosófica necessária ao debate, centrada nas discussões dos jusfilósofos contemporâneos Ronald Dworkin e Jeremy Waldron sobre a proibição do discurso de ódio e as respectivas consequências para a legitimidade da discussão política, faz-se essencial a fim de proporcionar padrões claros e coesos de restrições à liberdade de expressão no âmbito do discurso do ódio nas redes sociais, reservando-se aos casos em que não seja possível a composição posterior do dano. Com efeito, o tratamento constitucional e internacionalmente adequado é o da impossibilidade de haver censura prévia, responsabilizando-se, porém, o autor do discurso pelos abusos que cometer. Utilizou-se pesquisa qualitativa exploratória-descritiva sobre liberdade de expressão, sociedade em rede, discurso do ódio, controle legislativo e judicial.São Cristóvão, S
