Tinjauan Yuridis Implementasi Prinsip Fair Use Hak Cipta Atas Penjualan Photo Card Artis K-Pop pada Media Sosial

Objects of portrait copyrighted works related to the principle fair use in Law Number 28 of 2014 concerning Copyright in the form of selling photo cards artist K-Pop on social media which affect the moral rights and economic rights attached to the creator. The purpose of this study is to describe the IPR provisions relating to the copyright of photo cards artist K-Pop, as well as to find out the legal consequences for the parties regarding the principle of fair use of copyrights photo card artist K-Pop on social media. So the problem is investigated by normative or doctrinal research methods, using descriptive research types and literature study sources from secondary legal materials. The moral right to exist and be recognized as the creator so that the work is not changed photo card even though the copyright has been transferred. Furthermore, the categories of interests related to economic rights are creators (artists K-Pop), copyright holders (agency companies that oversee artists K-Pop), and consumers (fans). A written agreement or contract is required, and a license agreement is required for obtaining royalties, producing, distributing and marketing the product.
