Structural transphobia in brazilian prison: an analysis of normative ineffectiveness and jurisdictional behavior

Prison, in general, is recognized for being an environment in which inhumane treatment of prisoners is common. In the case of transgender women and transvestites, there is an aggravating factor, since, in addition to experiencing this context of dehumanization like any other person in custody, they are victims of transphobia. In view of this transphobic scenario, in recent years normative acts have been published on the treatment of LGBT+ people deprived of their liberty and, moreover, the Federal Supreme Court has started to discuss the allocation of transgender women and transvestites in Brazilian prison. Given this situation, the present research aims to analyze how the penal system deals with transgender women and transvestites, especially those deprived of their liberty, so that it is possible to verify whether the origin of ADPF n° 527 and Resolution n° 348/ 20, of the CNJ, are able to stop transphobic violence in the prison system. For this, at first, the work seeks to explore the cisgender and heteronormative historical context to understand the process of imposing the deviant status on transgender women and transvestites, as well as its reflexes in the penal and criminological system. Then, it investigates how transgender women and transvestites are currently criminalized, as well as the way they are treated in male prisons. Finally, normative provisions related to the incarceration of transgender women and transvestites are analyzed, in particular Resolution n° 348/20, of the CNJ, and the possible effects of ADPF n° 527. In order to carry out this study, official and unofficial public documents are explored and three theories are adopted as theoretical-methodological references: queer, the criminology of social reaction and queer criminology. These theories helped in the construction of the hypothesis that transphobia is a structural problem in the prison system, which makes it impossible for Resolution n° 348/20, of the CNJ, and the origin of ADPF n° 527 is suficiente to stop transfobia in brazilian prision.Dissertação (Mestrado)O cárcere, de forma geral, é reconhecido por ser um ambiente em que é habitual o tratamento desumano dos(as) presos(as). No caso das mulheres transexuais e travestis, há um agravante, já que, além de vivenciarem esse contexto de desumanização como qualquer custodiado(a), são vítimas de transfobia. À vista desse cenário transfóbico, nos últimos anos foram publicados atos normativos sobre a forma de tratamento das pessoas LGBT+ privadas de liberdade e, além disso, o Supremo Tribunal Federal passou a discutir sobre a alocação das mulheres transexuais e travestis no cárcere brasileiro. Diante dessa conjuntura, a presente pesquisa tem por escopo analisar como o sistema penal lida com as mulheres transexuais e travestis, sobretudo as privadas de liberdade, de modo que seja possível constatar se a procedência da ADPF n° 527 e a Resolução n° 348/20, do CNJ, são capazes de cessar a violência transfóbica no sistema prisional. Para isso, de início, o trabalho busca explorar o contexto histórico cisgênero e heteronormativo para compreender o processo de imposição do status de desviante às mulheres transexuais e travestis, bem como os seus reflexos no sistema penal e criminológico. Em seguida, averígua-se como as trans são atualmente criminalizadas, bem como a maneira que elas são tratadas nas unidades prisionais masculinas. Por fim, analisa-se dispositivos normativos relacionados ao encarceramento das mulheres transexuais e travestis, em especial a Resolução n° 348/20, do CNJ, e os possíveis efeitos da ADPF n° 527. Para proceder este estudo, são explorados documentos públicos oficiais e não oficiais e adota-se como referenciais teórico-metodológicos três teorias: a queer, a criminologia da reação social e a criminologia queer. Essas teorias auxiliaram na construção da ideia de que a transfobia é um problema estrutural no sistema prisional, o que inviabiliza que a Resolução n° 348/20, do CNJ, e a procedência da ADPF n° 527 sejam suficientes para cessar a transfobia no cárcere brasileiro
