The aim of this paper is to provide an analysis of the concept of burglary in the Polish criminal law, with a particular emphasis on the legal qualification of illicit contactless transactions perform ed using another person’s payment card. The judgment of the Polish Supreme Court of 22 March 2017, III KK 349/16, has been the starting point and the basis for the analysis. According to the judgment, a payment card transaction performed by an unauthorised person using contactless technology, which does not require an access code, constitutes the crime of burglary.
