After its constitution under Annex VII of the UNCLOS and while the ITLOS had already been requested to indicate provisional measures under Article 290(5) of the Convention, the arbitral tribunal established to settle the Enrica Lexie Incident has been seized of a new request for provisional measures by Italy. Italy requested that Sergeant Girone, who is on bail in New Delhi since 2012 at the residence of the Italian Ambassador due to his involvement in the death of two Indian fishermen, would be authorized to return to Italy for the duration of the arbitral proceedings which subjectmatter is to determine whether India or Italy has adjudicative jurisdiction on this incident.
