The “ clean hands” doctrine, often invoked in transnational investment arbitration cases, is subject to variation. The current study is based on the arbitral awards decided by the Permanent Court of Arbitration in July 2014 opposing the Russian Federation to the shareholders of the Yukos Enterprise. It analyses the way in which the international judge uses this doctrine at the preliminary stage as well as during the substantive stage of the adjudication in order to vary the amount of damages awarded.
