Signalement à la justice de viols conjugaux : le point de vue du médecin généraliste sur le bénéfice procuré au patient

Introduction: in France, domestic rape represents an important part of domestic sexual violence. The Government took measures in 2020 to reverse these facts, in particular by allowing the health professional to report to the Public Prosecutor, including without the patient's consent. For the general practitioner, this provision creates a duality between the need to preserve the relationship of trust and that of reacting to an imminent danger. This study seeks to determine whether, from his point of view, this possibility of reporting is beneficial for the patient.Methods: a qualitative study, based on a semi-structured interview, was carried out with general practitioners in Nord-Pas-de-Calais. 3 GP, with different profiles and places of practice, were interviewed. The interviews were transcribed, then analyzed in a cross-sectional manner.Results: GP discover the existence of rape following an event, a question, an abnormal attitude, or following a systematic screening. As part of a multidisciplinary network essential to optimal support for their patients, they agree on having a listening and advisory role, giving the patient the necessary keys to make their own choices in conscience. They are reserved on the recognition of the hold and moral constraint defined in Law No. 2020-936. All are reluctant to apply it, deeming it dangerous for them and for the patient.Conclusion: each GP has a different approach to the doctor-patient relationship, and estimates the benefit provided by this measure, on a case-by-case basis. Networking, consent, identification of warning signs, training, are essential keys for the practitioner to respond in the best way and in conscience to emergencies.Introduction : en France, les viols conjugaux représentent une part importante des violences sexuelles conjugales. Le Gouvernement a pris des dispositions en 2020 pour faire reculer ces faits, notamment en permettant au professionnel de santé de procéder à un signalement auprès du Procureur de la République, y compris sans le consentement du patient. Pour le médecin généraliste, cette disposition met en dualité la nécessité de préserver la relation de confiance et celle de réagir face à̀ un péril imminent. Cette étude cherche à déterminer si, de son point de vue, cette possibilité de signalement est bénéfique pour le patient.Méthodes : une étude qualitative, sur la base d’un entretien semi-directif, a été réalisée auprès des médecins généralistes du Nord-Pas-de-Calais. 3 médecins généralistes, aux profils et lieux d’exercice différents, ont été interrogés. Les entretiens ont été retranscrits, puis analysés de manière transversale.Résultats : les médecins généralistes découvrent l’existence des viols suite à un événement, une question, une attitude anormale, ou suite à un dépistage systématique. S’inscrivant dans un réseau pluridisciplinaire essentiel à un accompagnement optimal de leurs patients, ils s’accordent sur le fait d’avoir un rôle d’écoute, de conseil, donnant au patient les clés nécessaires pour effectuer ses propres choix en conscience. Ils sont mitigés sur la reconnaissance de l’emprise et de la contrainte morale définies dans la loi n°2020-936. Tous ont des réticences à l’appliquer, la jugeant dangereuse pour eux et pour le patient.Conclusion : chaque médecin généraliste a une approche différente de la relation médecin-patient, et estime le bénéfice apporté par cette mesure, au cas par cas. Le travail en réseau, le consentement, l’identification de signes d’alerte, la formation, sont des clés essentielles pour le praticien afin de répondre au mieux et en conscience aux urgences
