Under the principle of distinction States are obliged to distinguish between civilians and combatants in the context of armed conflict. According to the International Court of Justice, this is one of the cardinal pillars of international humanitarian law. The author reviews the foundations of this general principle of international law from a historical, political and ethical perspective.
