ANALISIS MAKNA PEMILU SERENTAK DALAM PUTUSAN MAHKAMAH KONSTITUSI NO. 55/PUU-XVII/2019 DAN IMPLIKASI HUKUM PENERAPAN PEMILU SERENTAK TERHADAP SISTEM PRESIDENSIL DI INDONESIA

Elections are the spirit of democracy in Indonesia. Elections based on democratic principles will result in democratic elections and lead to the stability of election administration. The provisions of Article 167 paragraph (3) and Article 347 paragraph (1) of Law no. 7 of 2017 concerning General Elections states that elections are held simultaneously. The formulation of this article does not have a concrete explanation regarding what is meant by simultaneous elections. Therefore, the formulation of this article is tested in the Constitutional Court to examine the constitutionality and meaning of simultaneous elections. The problems that will be studied in this paper are 1) The meaning and model of a constitutional simultaneous election based on the decision of the Constitutional Court no. 55/PUU-XVII/2019; 2) The legal implications of implementing simultaneous elections for the presidential government system in Indonesia. The research method in this paper is using a normative legal research type, using a statutory approach and a conceptual approach. This research produces the first conclusion, the meaning and model of a constitutional Simultaneous Election based on the decision of the Constitutional Court no. 55/PUU-XVII/2019 is a simultaneous election that combines the legislative election with the election of the President and Vice President simultaneously. And the model of holding simultaneous elections is divided into 6 (six) models of holding simultaneous elections. Second, the legal implications of implementing simultaneous elections for the presidential government system in Indonesia, namely: a) Strengthening the presidential government system, simultaneous elections that equate the legislative election period and the President and Vice President will stabilize the government because the President gets more support from the Legislature based on a coalition that formed before the election; b) Natural simplification of political parties; c) Harmonization of central and regional policies. Therefore, in the future, revitalization must be carried out in the form of revisions to Law no. 7 of 2017 concerning General Elections. This revision must include the model for holding simultaneous elections in the Constitutional Court's decision no. No.55/PUU-XVII/2019
