Lithuanian social policy of employment of the disabled in the context of UN Convention for persons with disabilities and it‘s effectiveness

The main goals of the study – to reveal legally based possibilities and obstacles for realization of the right to work of the Lithuanian disabled in the system of employment, it’s conformity to the UN Convention and economic effectiveness. Basic tasks for realization of the goals: 1. To frame the model of inclusive employment of the disabled into labor market according to the Convention statements in the field (Conventional model) and define it; 2. To assess the conformity of Lithuanian disability employment policy to the Conventional model and reveal the obstacles for implementation of the model as well as factors of discrimination of the disabled; 3. To traverse the efficacy and expedience of Lithuanian vocational training system of the disabled from a viewpoint of employment and financing; 4. To analyze the utilization of budgetary resources within the system of employment of disabled; 5. To estimate and assess the economic efficiency of the active means used for the disabled in to labor market. Methods – Qualitative content analysis of key Lithuanian legal acts regulating the social policy of employment of disabled; Survey of professional rehabilitation institutions of disabled; Analysis of statistical official data in the field. The outcomes and conclusions of investigation. The model of inclusive employment of the disabled into labor market was created for first time (Conventional model) and accordingly Lithuanian social disability employment policy was assessed. The study revealed: Most of legal acts regulating the social disability employment policy are unconformable with the statements of UN Convention in the field. The Law of social integration of disabled and the Law of social enterprises embody the essential obstacles for implementation of Conventional model, for legally claim separated informal and bound professional rehabilitation (PR) system for the disabled and charitable, paid by budget work in social separated but not in open labour market enterprises; The physically disabled persons (with motor, visual and hearing disabilities), appointed (within PR system) as having less than 20% efficiency, experience full legal discrimination, being recognized as absolutely invalid that preclude them to be employed in open labour market; The separated an informal professional training of the disabled within PR system is too expensive (51 thousand Lt -Lithuanian currency- for 5 month duration of PR curse for one disabled person) regarding Lithuanian economy level, has low efficacy and expedience from the viewpoint of employment even in social enterprises (SE); The budgetary cost of employment of disabled persons in SE increased a lot during last four (2005-2008) years (from 409 to 1114 Lt/month. for 1 working disabled person) conditioned the huge increasing of number of SE (from 37 to 82 during the period in question). The economic efficiency of active means of labor market in PR and employment in SE of the disabled is enormously low – only 0,1%, indicating that the work of disabled practically doesn’t get any profit for Lithuania society
