Legitimacy through transparency : an analysis of transparency in the European Union with special focus on regulation no. 1049/2001

Die Demokratie- und Legitimationsdebatte zur Europäische Union thematisiert umfangreich das Demokratiedefizit der EU Institutionen und der politischen Entscheidungsfindung sowie Rechtssetzung.In dieser Arbeit soll der Stellenwert der Transparenz sowie das Potential derselben in Bezug auf die Legitimation der EU aufgezeigt werden. Zunächst werden die Begrifflichkeiten der politischen Legitimation und Transparenz eingehend betrachtet und analysiert. Das Demokratiedefizit wird ebenfalls thematisiert und die Stellung der Transparenz in dieser Debatte erläutert. Des Weiteren wird die Entwicklung und Bedeutung des Transparenzkonzeptes in der EU und in einem internationalen Vergleich aufgezeigt. In der Folge wird eine detaillierte Darstellung des Kernstücks der Transparenzregelungen der EU, der Verordnung 1049/2001 über Zugang zu Dokumenten der EU Institutionen, erarbeitet. Der schwierige und langwierige Prozess der Revision dieser Verordnung wird ebenfalls durchleuchtet und weitere aktuelle Entwicklungen auf diesem Gebiet werden thematisiert. Abschließend werden exemplarisch Möglichkeiten aufgezeigt wie durch mehr Transparenz in bestimmten Bereichen die Legitimation der Entscheidungsfindung, Beschlussfassung sowie der Institutionen gestärkt werden kann. Bezüglich der Transparenzverordnung wird ausgeführt, wo deren schwächen liegen und wo die gegenwärtige Rechtslage noch Potentiale birgt einen wichtigen Beitrag zu erhöhter Legitimation zu leisten. Mehr Transparenz erhöht die Möglichkeiten der politischen und rechtlichen Kontrolle durch die Bürger der Union und steigert so die Verantwortlichkeit der Entscheidungsträger.The scientific debate about democracy and legitimacy in the European Union extensively discusses the democratic deficit of the EU institutions, of the decision-making and legislative process.This paper aims to highlight the importance and the potentials of transparency regarding the legitimation of the EU. Introductory the terms and frameworks of definition of ?political legitimacy? and ?transparency? are subject to an analysis and discussion. Furthermore the development and significance of the transparency concept for the EU and in an international context is elaborated. The democratic deficit of the EU will be addressed as well and the role of transparency in this debate is accentuated. This broad discussion is followed by a detailed illustration of the centrepiece of this thesis, Regulation No 1049/2001 regarding public access to EU documents. The lengthy and repeatedly delayed process of the revision of the transparency regulation will be treated and further recent developments in this field are briefly addressed. Finally selected recommendations are provided how increased transparency, in certain political and administrative areas, could positively affect the legitimacy of the institutions and of the decision-making process in the EU. Regarding the transparency regulation an assessment concerning strengths and shortcomings is be provided and currently unused potentials of the current legal framework for increased transparency and legitimacy are highlighted.
