URGENSI REAKTUALISASI KURSUS PRA NIKAH PASCA BERLAKUNYA PMA NO 20 TAHUN 2019 TENTANG PENCATATAN PERKAWINAN

This research was motivated by the issuance of Minister of Religion Regulation No. 20 of 2019 which abolished the Regulation of the Director General of Islamic Community Guidance Number DJ.II./491 of 2009 concerning the Prospective Bride Course Article 6 paragraph 2 requires a certificate of prospective bride and groom as a registration requirement, even though the old regulations have benefits and influences. which is great for the bride and groom and provides knowledge, understanding and skills in married life. The pre-wedding course program is very important for the bride and groom. Therefore, maintaining the integrity of the household is the way that must be taken to realize the birth of quality offspring and the benefit of the household. For this reason, according to the authors, it is necessary to return the old regulations, in the language of the compiler (reactualization) which are still useful for the bride and groom, into applicable regulations through an empirical juridical approach that examines how normative provisions are actually realized in society. This study focuses on 1) the urgency of the re-actualization of pre-marital courses at the KUA, Kemranjen District, 2) analysis of pre-marital courses according to the theory of legal awareness. This type of research is a (field research) with descriptive-analytical nature and uses an empirical juridical approach and makes the Regulation of the Director General of Islamic Community Guidance Number DJ.II./491 of 2009 concerning the Prospective Bride Course and Regulation of the Director General of Islamic Community Guidance Number: DJ. II/542 of 2013 concerning Guidelines for the Implementation of Pre-Marriage Courses and Regulation of the Minister of Religion No. 20 of 2019 concerning Marriage Registration as primary material, books and previous research related to pre-marital courses and other sources that are still related as secondary materials. The results of this study, firstly, as an effort to create a Sakinah family by providing knowledge, understanding, skills and growth to prospective brides, the KUA Kemranjen as an institution under the auspices of the Ministry of Religion that runs a prospective bride and groom course program or pre-wedding course today should be encouraged and confirmed by giving strict sanctions for those who do not follow and run it seriously, likewise it is appropriate that the prospective bride and groom course be one that must be included in the Minister of Religion Regulation No. 20 of 2019 concerning marriage registration article 4. Marriage has urgency because it contains a positive value for the bride and groom. Based on the analysis of pre-marital courses according to the theory of legal awareness, carrying out pre-marital courses will give birth to knowledge, understanding legal understanding, giving birth to legal attitudes, and becoming legal behavior.
